Choose permission that matches the activity

Italy has several immigration routes with materially different purposes. The elective-residence route is for people supported by independent resources who will not work in Italy; it is a poor fit for a founder who intends to continue running a business from an Italian home. The digital-nomad and remote-worker route is restricted to qualified work and requires evidence of the professional pathway, previous activity, insurance and accommodation.

The investor route offers four qualifying categories: €2 million in government bonds, €500,000 in an Italian limited company, €250,000 in an eligible innovative start-up or €1 million in a qualifying philanthropic donation. A personal property purchase is not one of those categories. EU free-movement rights require a separate analysis from these non-EU visa routes. Choose the route before signing a lease or designing the tax position; permission to live, permission to work and a tax election are different legal decisions.

When an individual becomes Italian tax resident

Since the 2024 reform, the domestic test looks at whether, for most of the tax year, an individual has civil-law residence in Italy, domicile in Italy, or physical presence there. Fractions of days matter. Domicile for this purpose focuses on personal and family relationships; registration in the resident population register creates a rebuttable presumption. These are alternative tests, so spending fewer than 183 days in Italy is not a universal safe harbour.

A family moving its main home to Italy while the business owner travels extensively needs a fact-based review of both the family and the travel pattern. If another country also treats that person as resident, apply the relevant treaty rather than assuming the Italian permit settles the conflict. Preserve the chronology of accommodation, family relocation, travel and work from the beginning.

Ordinary taxation and the new-resident election

Ordinary Italian residents generally enter the worldwide-income system, with income classification, foreign tax relief and foreign-asset reporting requiring separate attention. Employment performed in Italy is not automatically foreign income merely because the employer or customer is overseas. Distinguish dividends, salary, business profits, investment disposals, pensions and trust distributions before calculating the result.

The optional new-resident substitute tax concerns qualifying foreign-source income. For new transfers within the 2026 amendment, the annual principal amount is €300,000 and the qualifying family extension €50,000 each. Earlier entrants can fall under earlier amounts. Applicants generally need nine nonresident years in the preceding ten, and the election lasts no more than fifteen years. The first-five-year exclusion for certain substantial foreign shareholding gains is particularly relevant to founders approaching a sale. Italian-source income remains outside the foreign-income substitute charge.

A foreign company can acquire an Italian tax connection

A company’s legal seat, effective management and principal ordinary management are distinct residence connections under the reformed rules. A foreign certificate of incorporation does not decide where the business is actually directed. Review who approves budgets, signs major contracts, hires senior staff and controls financial risk, and where those people carry out the work.

Corporate residence, a permanent establishment and controlled-foreign-company attribution are different questions. A company might remain foreign resident yet have taxable operations in Italy; alternatively, an Italian owner can face an attribution question without changing the company’s residence. Italy’s CFC legislation can concern resident individuals as well as corporate owners. The 2024 amendments changed the low-tax analysis, so a pre-reform checklist should not be reused mechanically. Control, income composition, effective foreign taxation and the genuine-activity exception need a current Article 167 review.

Sequence consular approval, entry and residence registration

For an investor, the published committee assessment for the Nulla Osta is 30 days, with suspension possible for further evidence. The visa application follows within six months of clearance. After entry, the residence-permit request is due within eight days, and the qualifying investment must be completed within three months. Those are legal or published procedural timeframes, not an end-to-end service guarantee. Banking checks and consular appointments can extend preparation.

For other routes, use the competent consulate’s actual checklist and appointment system. Qualification recognition, legalisation and translations should be started early. Do not infer a processing estimate from the validity of the visa or the eventual card. Keep separate records for the entry visa, permit application receipt, physical residence card and municipal registration. A delay in issuing one document does not automatically extend another filing deadline.

Departure is tested against the full residence facts

Leaving Italy requires analysis of the majority-of-year tests for residence, domicile and physical presence. Ending a lease or removing a name from a register may support the facts, but neither is a complete answer if the person’s main personal and family relationships remain in Italy. The exact departure date, retained accommodation, spouse and children, travel and working pattern should be assessed together.

Do not assume that a midyear move automatically gives domestic split-year treatment. Establish the domestic result and then review the relevant treaty and administrative position for the actual destination. A foreign residence certificate is useful evidence but should be consistent with where the person lived. Retain a contemporaneous file showing the new home, lawful residence, local registrations, travel and the practical relocation of personal life.

Descent rules changed substantially in 2025

Italian ancestry does not by itself establish current eligibility for citizenship recognition. The 2025 amendments introduced restrictions for people born abroad who possess another citizenship, subject to statutory exceptions and transitional protections. Relevant exceptions include a parent or grandparent who exclusively holds, or held at death, Italian citizenship, and a parent’s qualifying continuous residence in Italy before the child’s birth or adoption. Existing applications and proceedings require their own date-based analysis.

Build the complete chain of birth, marriage, naturalisation and nationality-loss events before ordering a large document package. A foreign ancestor’s naturalisation date, the child’s birth date and historical transmission rules can change the result. Recognition, reacquisition and a new grant by naturalisation are different processes; use the route that follows the evidence rather than assuming every person with an Italian grandparent has the same claim.

Residence and marriage provide separate routes

The standard residence period for a non-EU national seeking naturalisation is ten years of legal residence, with shorter statutory categories for certain applicants. The minimum residence period is an eligibility threshold, not a promised decision time. Continued residence, income and conduct requirements need to be checked against the actual category. Language evidence generally requires B1 Italian unless an applicable exception applies.

For marriage or civil union, the general waiting periods are two years of legal residence in Italy after the marriage or three years if resident abroad, reduced by half where the couple has children. The marriage must be properly recorded, and the relationship conditions continue to matter during the process. A residence permit obtained through investment does not replace the language, residence, character or documentary requirements for citizenship.
