Eligibility & suitability
Who can qualify
- Individuals transferring tax residence to Italy who satisfy the prior non-residence condition and validly elect the regime.
- Qualifying family members where extension conditions are met and the additional annual charge is justified.
Restrictions & unsuitable cases
- People merely holding an Italian visa or property without establishing the necessary tax residence.
- Applicants expecting Italian work income or every early share disposal to be covered by the annual charge.
Application process & timeline
The sequence below separates application preparation, official decision stages and continuing obligations. A statutory deadline or published target is not an estimate of end-to-end delivery.
01Reconstruct the preceding ten tax yearsBefore relocation and any major disposal.
Document residence under Italian domestic rules and relevant treaties for each year. Identify any year involving an Italian home, family connection, registration or substantial physical presence.
Documents & evidence
- Prior tax returns and certificates
- Travel and housing history
- Treating absence of an Italian tax return as proof of non-residence
02Model ordinary tax against the electionBefore choosing the first residence year.
Classify income by source and legal category, identify substantial shareholdings and estimate annual covered income. Model principal and family charges using the correct transfer-date rules.
Documents & evidence
- Asset and income inventory
- Share registers and cost basis
- Expected transaction calendar
- Using obsolete fixed-tax amounts
- Ignoring an unusually low-income year
03Resolve uncertain facts and immigrationBefore committing to the move.
Assess whether an advance ruling is appropriate and organise a separate lawful immigration route if required. Prepare one factual explanation consistent across tax and immigration records.
Documents & evidence
- Ruling submission where used
- Visa/residence basis
- Historical residence evidence
- Assuming a tax ruling gives permission to reside
04Establish residence and make the electionElection through the applicable tax-return procedure.
Record the first year of Italian tax residence and the scope of the election, including any family extensions or excluded jurisdictions. Verify the current return and payment deadlines with the filing adviser.
Documents & evidence
- Italian registration and residence evidence
- Tax return election
- Family documentation
- Missing the election while relying on the regime in calculations
05Pay the annual charge and keep recordsEach elected tax year; statutory tax deadlines must be verified for that year.
Pay the applicable fixed amount and separately report income outside its scope. Retain source classifications and transaction evidence even where a reporting exemption applies.
Documents & evidence
- Payment receipts
- Ordinary income schedules
- Source and ownership records
- Assuming the fixed payment covers Italian-source income
06Review changes and the end of the regimeAnnually and before a sale, departure or family change.
Review withdrawal, loss of eligibility and expiry before they occur. Prepare the ordinary-tax position that will apply afterwards rather than waiting until the final covered year.
Documents & evidence
- Updated income model
- Residence calendar
- Exit or withdrawal analysis
- Treating a temporary absence as automatically restarting the 15-year period

Use the current amount, not a historic brochure
Italy’s 2026 Budget Law increased the annual substitute tax to €300,000 for qualifying new transfers of residence, with €50,000 for an eligible participating family member. The law’s effective-date provisions matter. The investment ministry’s older English explanation still displays earlier amounts and should not be used as a 2026 price quotation.
The regime is intended for eligible people who were not Italian tax resident for at least nine of the ten preceding tax periods. It can run for up to fifteen years. This is a personal tax election; it is not an immigration permission and does not provide a company with a matching exemption.
The useful calculation is income-specific
Inventory salary, dividends, interest, rental income, investment gains, carried interests and trust distributions before comparing the annual charge with ordinary taxation. Establish source under the applicable Italian rules and examine exceptions. Income from activity actually performed in Italy cannot simply be treated as foreign because the payer or bank account is overseas.
Then model foreign withholding and taxes that remain payable elsewhere. A flat Italian charge does not mean the worldwide tax bill equals that charge. Family members, companies and assets should be modelled separately, including a year in which income is lower than expected.
Evidence and application
Build a ten-year residence history supported by returns, certificates and factual ties. Map the proposed Italian arrival date and identify any uncertain eligibility or income-characterisation questions. The official regime explanation describes the possibility of an advance ruling; decide whether that route adds useful certainty to the case.
The engagement should specify who handles the election, tax return, annual payment and correspondence, as well as the treatment of family extensions. Obtain current confirmation of deadlines and cessation consequences before filing. The relevant timing is the tax period and compliance calendar, rather than a residence-card delivery estimate.
Plan beyond the election
Review estate planning, asset reporting and the company’s real management as connected but distinct issues. Build a forecast for the end of the regime or an earlier departure. This route can be valuable for an appropriate income profile, but the number on a brochure should follow a documented comparison of the alternatives.
The 2026 amount and earlier entrants
The annual substitute-tax amount depends on the date and transitional rules governing the transfer. For applicable new transfers from 2026, the budget legislation raises the principal amount to €300,000 and the amount for each qualifying family member to €50,000. Older official promotional pages still display earlier amounts. Do not use a historical €100,000 or €200,000 headline to budget a fresh 2026 move; retain the law and evidence of the transfer date used in the analysis.
The fixed amount is payable irrespective of how much covered foreign income arises in that year. Compare it with the ordinary liability on the expected income mix, rather than multiplying all worldwide wealth by a tax rate. A family extension is a separate cost and eligibility decision. A year with little foreign income can make the fixed charge relatively expensive.
Scope, exclusions and the first five years
Article 24-bis is a personal income-tax election for qualifying new tax residents, broadly requiring non-residence in nine of the previous ten years. The maximum duration is 15 tax years. It concerns qualifying foreign-source income, not all money received from a foreign bank account. Italian-source earnings and business activity require their own treatment. Certain gains on substantial foreign shareholdings during the initial five-year period remain outside the substitute-tax cover.
For an entrepreneur planning a sale, the shareholding category, timing, company residence and place of work matter more than the label applied to the bank account. Prepare a transaction map before electing: seller, legal asset, beneficial owner, percentage interest, acquisition history and proposed completion date. A foreign-incorporated company managed from Italy can also undermine assumptions about the foreign source of a later distribution.
Election mechanics and evidence
The election is made through the Italian tax-return process; a ruling can be used to obtain certainty about eligibility and the facts presented. The ruling and election are not immigration applications. A person who needs a visa must obtain one through a separate route, and should not make a tax election on the assumption that immigration permission is assured.
Keep an evidence file covering prior tax residence, family members, income categories and any country excluded from the election. A country-by-country exclusion can change the interaction with foreign tax credits and treaty relief, so it should be modelled rather than treated as an administrative preference. Annual payment, continued eligibility, withdrawal and the end of the 15-year term need a calendar from the first year.
