Decide whether you are moving in or building abroad

Australia can be the centre of a family’s life and business, or the country from which an entrepreneur expands internationally. Those lead to different planning questions. A resident who forms an overseas company has not necessarily moved profits beyond Australian taxation. A person relocating abroad needs a documented residence and departure analysis.

Immigration routes have changed

The Business Innovation and Investment Programme closed to new applications on 31 July 2024. Existing holders can have transitional options, but an old Significant Investor description is not a current open application route. National Innovation is a different, invitation-based permanent visa for exceptional talent; investment capital alone is not its organising principle.

Know the cost of changing residence

Australian tax residents generally face worldwide taxation, with important temporary-resident distinctions. CFC rules, trusts, superannuation, property and unrealised gains can make arrival or departure materially more complex than changing an address. Assess these before selling a business, distributing cash or transferring management to another country.

An international structure must account for Australian residence

An Australian-resident owner can remain taxable on foreign income even when a company and bank account are overseas. The first question is whether the owner stays resident, followed by whether the foreign company is genuinely nonresident and whether CFC attribution applies. Those are separate tests. A structure that ignores one can create overlapping tax and reporting instead of the expected saving.

For an outbound business, identify the functions genuinely performed overseas: management, product development, sales, staff and risks. The Australian business should be compensated appropriately for what it continues to do. A foreign company that invoices customers while all high-level decisions remain with its Australian owner needs a careful central-management-and-control analysis. Incorporation is an implementation step after that work, not evidence that the tax answer has already been settled.

The current migration routes are not the old investor programme

The Business Innovation and Investment programme closed to new applications on 31 July 2024. Existing holders require transitional advice, but a new applicant should not be sold an obsolete investor category. National Innovation is an invitation-based permanent route for people meeting exceptional-achievement requirements. A large bank balance by itself does not establish that profile.

Skilled Independent 189 uses an eligible occupation, skills assessment, age, English and points criteria. Sixty-five points is a threshold for the points-tested route, not an assurance of invitation. An entrepreneur should compare genuine employment, skills, family and innovation pathways rather than trying to make a closed investment route fit. The linked programme pages distinguish expression of interest, invitation, application and grant, with documents for each stage.

Arrival planning can change the tax result years later

Before moving, compile ownership and valuation records for businesses, investments, trusts, pensions and employee equity. Immigration permanent residence and tax residence use different rules. Some people can qualify as temporary residents for tax purposes while resident under the ordinary income-tax tests; eligibility also involves the visa and family circumstances. The resulting foreign-income and capital-gains treatment can differ materially.

The end of temporary-resident status is another event to plan for. A change in visa or spouse-related facts can alter future taxation even though the household has not moved. Review a planned business sale, dividend or investment disposal before the event. Reliable historical records are difficult to reconstruct once a company has been sold, an account closed or a foreign adviser is no longer involved.

Departure requires an asset-level calculation and governance plan

Ceasing Australian tax residence can trigger CGT event I1 for relevant assets outside taxable Australian property. An individual may choose to disregard the departure gains and losses, but the choice can keep the affected assets within the Australian CGT net for later events. It is therefore a trade-off about timing and future exposure, not simply a tax cancellation. Temporary-resident treatment and treaties can alter the analysis.

A departure plan should identify each asset’s owner, cost, value, tax category and proposed disposal date. It should also state what happens to company management, trusts, retained property and ongoing Australian-source income. The receiving country may have a different starting value or tax timing, creating a mismatch. Offshore Capitalist can coordinate the cross-border design and implementation, including appropriate independent valuation and local advice where the work requires it.
