Eligibility & suitability

Who can qualify

  • Invited applicants able to prove internationally recognised exceptional and outstanding achievement in an eligible field.
  • Applicants with an eligible reputable nominator and the required health, character and family evidence.

Restrictions & unsuitable cases

  • People without an invitation or who lodge outside the invitation window.
  • Applicants treating NIV as a replacement investor purchase programme.
  • Applicants unable to substantiate the achievements claimed in their EOI.

Application process & timeline

Selection for an invitation and assessment of the visa are separate. Neither has a universal guaranteed completion date.

01Test the achievement caseBefore preparing the EOI.+

Assess international recognition, current prominence and the intended Australian contribution. Distinguish independently documented results from promotional claims. Consider other visas if the case is primarily ordinary employment or investment.

Documents & evidence

  • Achievement evidence
  • Contribution plan
Common complications
  • Equating company revenue with exceptional international standing

02Prepare and submit an EOIEOI remains active for two years.+

Submit accurate claims supported by the appropriate evidence and current priorities. Keep the submitted version because the later application must prove the achievements used for selection. An EOI is not the visa application.

Documents & evidence

  • EOI
  • Evidence index
Common complications
  • Making unsupported claims to improve selection chances
References [1][6]
03Await an invitation and prepare contingenciesNo invitation guarantee; EOI can expire unselected.+

Maintain a viable residence and business plan elsewhere while waiting. Prepare likely identity and nomination evidence without assuming approval. Do not make an irreversible household move solely because the EOI has been lodged.

Documents & evidence

  • Current status documents
  • Potential nominator records
Common complications
  • Treating the two-year EOI validity as a promised waiting time
References [1][6]
04Lodge the formal applicationWithin sixty days of invitation.+

Submit through ImmiAccount with the completed Form 1000 and evidence supporting the invited claims. Home Affairs states that it will not process an application lacking the nomination form. Check the fee and all family inclusions at lodgement.

Documents & evidence

  • Invitation
  • Form 1000
  • Full application
Common complications
  • Missing the invitation deadline or nominator form
References [1][6]
05Complete immigration assessmentCase-dependent health, character and evidence checks.+

Respond to document requests and complete the required examinations and disclosures. Changes in circumstances must be addressed truthfully. The invitation does not waive the formal eligibility decision.

Documents & evidence

  • Health/character records
  • Additional evidence
Common complications
  • Assuming exceptional talent removes standard admissibility checks
References [1][6]
06Settle and maintain travel statusAfter grant, using the dates and conditions in the visa.+

Coordinate entry, housing and business implementation with the pre-arrival tax plan. Track the travel facility separately from indefinite residence and review later citizenship eligibility. Foreign business management should reflect what actually occurs after arrival.

Documents & evidence

  • Grant
  • Travel calendar
  • Business governance records
Common complications
  • Ignoring the travel-facility expiry

A selective route, not an investment purchase

The National Innovation visa, subclass 858, is a permanent route for exceptionally talented applicants. It replaced the former Global Talent visa framework. It is not a reopening of the Business Innovation and Investment Programme, which closed to new applications on 31 July 2024. A wealthy entrepreneur still needs evidence meeting the actual talent and achievement criteria.

Eligibility and limitations

Assess the applicant’s record, international standing, contribution to Australia and required nomination. The relevant field and evidence must meet the current criteria and selection priorities. Submitting an expression of interest is not an invitation, and an invitation does not remove the need to prove eligibility in the formal application.

Evidence and process

Prepare a concise achievement record supported by independent evidence, professional recognition, business outcomes and the proposed Australian contribution. After an invitation, submit the application through ImmiAccount with the required nomination form and identity evidence. Home Affairs lists police checks and supporting documents, and health requirements also apply. Family members need their own qualifying documents.

Costs and timing

Budget the government charge, any additional applicant or English-related charges, medical examinations, police certificates, translations and professional work separately. Neither invitation timing nor final processing is guaranteed. Avoid relocating a business or making irreversible household commitments solely because an expression of interest has been lodged.

Tax and settlement

Permanent immigration permission does not answer the commencement of tax residence or the treatment of existing foreign companies and assets. Review that before arrival. Establish the practical settlement and operating plan, including family work, schools and management responsibilities. Citizenship remains a later application with its own residence, character and other requirements.

What an invitation actually establishes

Home Affairs describes NIV as an invitation-only permanent visa for established or emerging leaders with internationally recognised exceptional achievement. Researchers, entrepreneurs, innovative investors, athletes and creatives can be relevant, but being wealthy or operating a profitable ordinary business does not by itself meet that standard. The evidence should connect the person’s achievements with their standing in the field and prospective contribution to Australia.

The expression of interest remains active for two years. It may expire without an invitation. Home Affairs expressly says an invitation is not a pre-assessment that all visa requirements are met. Avoid presenting the EOI as an approval-in-principle or selling an investment commitment as a way to compel selection.

Nomination and evidence need substance

The formal application requires Form 1000 from an eligible nominator with a national reputation in the applicant’s field: an Australian citizen, permanent resident, eligible New Zealand citizen or Australian organisation. A flattering recommendation without the required standing is not equivalent. The nominator should be able to explain the applicant’s actual achievements rather than merely repeating a prepared promotional biography.

Prepare independent recognition, business or research results and a documented Australian contribution. Identify the evidence behind each EOI claim because the application must substantiate the achievements that led to the invitation. Family identity, relationship, health and character evidence remains necessary; a distinguished professional record does not replace immigration screening.

Commitment, costs and permanent residence

There is no simple published investment amount that purchases NIV. Capital committed to a venture should be justified commercially and should not be described as a government visa contribution. Budget the current immigration charge and household additions separately from medicals, police certificates, translations and any professional assistance. Check the live charge at lodgement because it can depend on applicant circumstances.

Permanent residence and travel rights are related but distinct. Home Affairs describes a five-year travel facility with this permanent visa; future international travel may require an appropriate resident-return permission if citizenship has not been obtained. Before settling, model Australian personal residence, foreign companies, trusts and investments rather than assuming the immigration grant supplies a favourable tax regime.
