Residence starts with your home and centre of wealth

Belgian personal residence is a factual test of domicile or the seat from which wealth is managed. National-register entry creates a rebuttable presumption. A temporary trip abroad does not move the domicile, and a residence card is not a separate exemption from tax. A founder with a Belgian family home and day-to-day life here needs a residence analysis even if most clients, investments or companies are overseas.

Residents generally bring worldwide income into the Belgian system. The next question is how each category is taxed or relieved under the relevant treaty. Nonresidents may still have Belgian-source salary, pension, rental or business income and a nonresident return. A treaty residence tie-breaker requires the actual bilateral treaty and the household facts; it should not be replaced with a universal 183-day assumption.

2026 income-tax bands

The table concerns income earned in calendar 2026, assessed in 2027. Apply marginal bands to the appropriate taxable base, after the relevant income-category deductions. The basic exempt amount is €11,180 for 2026, with possible increases for the household situation; this is not permission to remove the same amount from every separate income category.

As a narrow arithmetic illustration, €40,000 of taxable income before exempt-amount relief spans €16,720 at 25%, €12,790 at 40% and €10,490 at 45%: €14,016.50 before that relief and other adjustments. This is not gross salary-to-net pay, and no municipal tax, credits or social charges are included.

Your address affects the final bill

Flanders, Wallonia and Brussels-Capital are relevant to regional reliefs and the allocation of personal taxation. Municipalities set their additional income-tax percentage each year. This is a percentage of the relevant income-tax amount, not a second tax band on gross salary. A hypothetical 7% municipal addition to a €10,000 relevant tax amount is €700; it is not €7,000 on a €100,000 salary.

The tax administration identifies the region and municipal rate using the residence on 1 January of the assessment year. Cross-year moves, part-year residence and treaty-exempt income need their own calculation. No unverified 2026 municipal-rate matrix is supplied here; a Brussels headline must not stand in for every Belgian address.

Employment, self-employment and company income are different bases

Salary must be reconciled with benefits, employer reimbursements, personal social contributions and either the applicable standard professional-expense deduction or substantiated actual expenses. An employment contract, tax withholding and a Belgian payroll can coexist with foreign workdays that require treaty allocation. Payroll withholding is an advance, not necessarily the final annual liability.

A sole trader should model professional profit and the self-employed social system. A shareholder should separately model company profit, salary or director remuneration, dividends and eventual share gains. Incorporating a company does not transform remuneration for the owner’s work into tax-free investment income. The detailed self-employed 2026 contribution thresholds have not been independently transcribed in this guide.

Dividends, interest and capital gains need separate records

The ordinary withholding-tax starting point for movable income is 30%, with qualifying reductions and exemptions. A Belgian intermediary’s withholding may settle the resident’s liability for the income in question, but income without Belgian withholding can require declaration. A foreign broker does not make foreign dividends or interest invisible to the Belgian return.

The new financial capital-gains legislation is effective from 1 January 2026. It reaches ordinary private financial investing as well as specified insurance and crypto assets. The standard category is 10%; shareholdings of at least 20%, transfers to a company controlled by the seller or specified family members, professional activity and transactions outside normal private management require separate classification. They cannot all be run through a 10% portfolio example.

Document financial-asset value when Belgian residence begins

New article 102§3 values covered financial assets at the first day the individual becomes subject to Belgian personal income tax on moving domicile or the seat of wealth into Belgium. This is an arrival-value rule for the financial-gains framework, not a universal revaluation of property, professional assets, pension entitlements or company tax bases.

For example, an ordinary covered portfolio acquired for €200,000 abroad, worth €300,000 on the documented first Belgian tax day and later sold for €340,000 begins with a €40,000 Belgian gain before statutory adjustments or reliefs. A return within 24 months following a departure whose exit-payment obligation is cancelled has an express exception: the intervening move is effectively disregarded, with a prescribed adjustment for a similar foreign tax. Preserve both original cost and dated valuations.

Property and pensions do not follow the portfolio rule

Inventory Belgian and foreign property separately from securities. Rental use, private versus business occupation, cadastral reporting and the applicable treaty can alter the Belgian base. A foreign pension also needs its own classification: periodic benefits, a lump sum, employment history and the relevant treaty article can lead to different results. Do not infer a pension exemption from a general capital-gains rate.

Gift, inheritance and property-transfer taxation are additional, region-sensitive questions. Before a family move or a large transfer, record residence history, property location, ownership, beneficiary relationships and the proposed date. This bundle does not supply a complete regional succession schedule; that remains a distinct research and implementation task.

Foreign companies, trusts and accounts must be reviewed

Belgium’s individual legal-arrangement attribution framework, often called the Cayman tax, is distinct from the corporate CFC regime. The 2026 capital-gains law expressly coordinates income already taxed through legal arrangements with later distributions. A trust, foundation or low-tax entity needs classification under those specific rules; this guide does not claim every foreign company is attributed to an individual.

Belgian residents must report foreign accounts to the National Bank’s Central Point of Contact. The account’s existence, taxable income and the treatment of any holding entity are separate reporting questions. Keep opening and closure details, beneficial-owner information, statements and evidence of tax already paid. Account reporting is not a substitute for the income-tax return.

The inbound regime is an employment relief

The current public-agency summary describes eligible recurring employer-cost reimbursement up to 35% of gross remuneration and a €70,000 annual-remuneration condition for the inbound-taxpayer route; researchers have a different qualification test. Recruitment abroad or an eligible group assignment, the five-year prior-history conditions and distance from the Belgian border must be checked. The regime does not create immigration permission or a blanket exemption for the household’s investment income.

The employer must apply with the employee’s attestation and supporting evidence within three months of the Belgian start. The initial period is five years; extension needs an application. The official taxpayer application form excludes director applicants who are founders/cofounders or hold more than 30% of the company’s capital. An entrepreneur should test that restriction before budgeting an expat allowance. This dataset does not supply a complete payroll-engine implementation of the regime.

A departure now includes a financial-asset exit review

The 2026 law treats a transfer of domicile or the seat of wealth outside Belgium as a disposal for covered financial gains. A qualifying destination can give automatic payment deferral; other destinations require a request and adequate security. Disposal, collateral transactions or a later move can terminate deferral. Annual evidence is required to maintain it.

The legislation also provides cancellation of the payment obligation in prescribed cases, including return within 24 months or expiry of 24 months with the conditions maintained. These rules require an asset-level departure file, destination analysis and continuing calendar. Final resident reporting and later Belgian-source nonresident reporting remain separate. Current 2026 return deadlines for 2025 income should never be reused as deadlines for 2026 income.
