Prove where life and decisions move
A flight booking or deregistration alone does not resolve tax residence. Belgium’s domicile/seat-of-wealth test concerns real facts. Record the new home, household move, work location and where assets are managed, alongside the outgoing administrative steps. Temporary absence can leave the Belgian domicile intact.
A company requires a separate decision. The owner may leave while the company remains managed in Belgium; alternatively, moving decision-making abroad can raise an entity exit issue. Map the personal and corporate dates and the new country’s entry rules rather than assuming they all change together.
Value covered financial assets before departure
The 2026 financial-gains law treats the move of domicile or seat of wealth abroad as a disposal. Prepare asset costs,2025 opening values where relevant, arrival values, market values at departure and statutory category. A founder’s shareholding or related-party transaction may not fall into the ordinary 10% category.
Analyse payment deferral separately from the taxable event. The destination’s information-exchange and recovery-assistance position matters. Maintain annual attestations and track disposals, collateral and further moves. Prescribed cancellation may follow a return within 24 months or 24 months of compliance; failure to maintain the conditions can change the payment result.
Decide what remains operational
Review the Belgian office, staff, inventory, contracts and decision-making roles. If a Belgian business or PE remains, it needs a continuing tax and administration owner. Moving an asset or management abroad can create corporate exit taxation; qualifying payment spreading has an election process rather than an informal assumption.
Employment termination, cross-border remote work and continued director duties also need social-security and payroll review. Keep the distinction between a resident individual, a nonresident receiving Belgian income and a company that continues operating in Belgium.
Keep enough access to finish the filings
Coordinate the closing resident period and later nonresident returns with the tax office. Belgian-source salary, pension, rental or business income may continue after the move. Preserve access to MyMinfin and records, notify financial institutions of the actual new tax residence, and update reportable account changes.
Do not close every payment account before final taxes, refunds and service charges can be settled. The practical handover should name the person monitoring assessments, deadlines and the financial-gains deferral evidence. A departure plan is complete only when the continuing obligations have an owner.
