Application and implementation sequence
Government decision times vary by route and case. These stages show the application dependencies and legal milestones; confirm the current application pack and fee quote before filing.
01Confirm the route and applicable lawBefore committing capital
Check the applicant, household and intended work. Record whether a transitional rule applies and which investment evidence is required.
Documents & evidence
- Passports and residence history
- Family relationships and intended activities
- Treating a residence certificate as unrestricted work permission
- Using pre-May 2026 permanent-residence timelines
02Assemble investment and maintenance evidenceBefore the application or approved investment deadline
Prepare the property or business file and demonstrate control of funds. Complete legal and commercial checks separately from the immigration eligibility review.
Documents & evidence
- Business plan, licences, ownership and funding records
- Financial statement and bank reference
- Traceable source-of-funds records
- Counting a financed purchase price as the qualifying paid-up investment
- Assuming immigration approval replaces a business licence
03Complete time-sensitive family documentsClose to filing
Use the current WORC checklist and resolve medical-document validity before obtaining reports. Include approved health cover and properly certified or translated family records.
Documents & evidence
- Medical certificate within the enacted three-month limit
- Current police clearance where required
- Health insurance
- Birth and marriage/civil-partnership certificates
- References and certified passports
- Using the twelve-month medical wording on an older checklist without reconciling the law
- Omitting an adult child’s separate eligibility
04Submit and respond to the authorityDecision timing depends on the case
A proposed shareholder who has not yet met the ownership, substantial-presence or licensing requirements may receive six-month approval in principle. A qualifying senior manager or already-qualified shareholder may instead receive the full certificate directly; satisfy all remaining conditions and obtain the actual grant before relying on the permission.
Documents & evidence
- Completed current form
- Fee receipt
- Any requested supplementary evidence
- Confusing an annual declaration with an initial application form
- Starting work before the relevant permission is effective
05Maintain the approved arrangementThroughout the certificate period
Preserve investment, insurance and family eligibility; make the required declarations and payments. Record presence where the route requires it.
Documents & evidence
- Annual declaration and investment evidence
- Insurance renewals
- Travel log and business records as applicable
- Missing the earlier of full-time tertiary education completion or the child’s twenty-fourth birthday
- Allowing business activity or occupation to depart from the approval
For qualifying owners and senior managers
Substantial business presence is an operating-business route. The applicant generally qualifies through at least 10% ownership of an approved-category business or employment in a qualifying senior management capacity. The business must establish a genuine Cayman presence; a registered office alone is not the proposition described by this route.
The regulations’ approved categories include financial and professional activities such as fund administration, brokerage, investment/fund management, family offices and specified other businesses, including exempted companies. The entity’s classification does not remove sector licensing or substance obligations.
The business-presence evidence
The senior-management definition refers to prescribed occupation-fee thresholds and particular business categories. Ask WORC to confirm the current occupation classification rather than substitute salary or job title.
| Requirement | Practical evidence |
|---|---|
| Physical commercial presence | Purchase or lease of commercial premises used by the business |
| Local team | At least four full-time employees legally and ordinarily resident in Cayman for at least nine months in the calendar year |
| Owner route | At least 10% ownership evidenced through company records |
| Senior management route | Role and prescribed occupation-fee category, not merely a senior-sounding title |
| Applicant presence | At least ninety days in aggregate each calendar year |
| Licensing | Permissions for the business’s real activities |
Permission and approval sequence
Six-month approval in principle is available to a proposed shareholder who does not yet meet the shareholding or substantial-business-presence requirements, or has not obtained the necessary licences. It is not a mandatory first stage for everyone. A qualifying senior manager or an already-qualified shareholder can receive the full twenty-five-year certificate directly under section 50(3), subject to the authority’s assessment. Renewal is discretionary and the approved work must match the business and occupation.
Map the recruitment, premises, licensing and banking dependencies before filing. A proposed future headcount needs a credible implementation sequence; obtaining a residence document does not make an unstaffed business operational.
Spouse, children and work rights
Spouses or civil partners and qualifying dependent children require approval; dependent residence does not itself permit unrestricted employment. This route has its own child-continuation rule: under section 50(8), dependent residence ends when the child completes full-time tertiary education or turns twenty-four, whichever comes first, unless the Director accepts statutory special circumstances.
The special-circumstances definition concerns a child who remains involuntarily wholly or substantially dependent because of a physical or mental disability. Keep education, relationship, health and dependency evidence current and obtain a decision before relying on continued residence. Do not substitute the age-eighteen variation rule from the independent-means or direct-investment routes.
Costs and annual obligations
The smaller issue fee compared with property routes does not represent the total cost. A functioning local business has recurring commitments that should be budgeted independently.
| Charge | Published 2026 treatment |
|---|---|
| Application | CI$1,000 |
| Issue | CI$12,500 |
| Approved dependant | CI$3,000 issue and CI$3,000 annual fee each |
| Annual work charge | Equivalent to the applicable occupation’s prescribed work-permit fee |
| Annual declaration | CI$500 prescribed fee |
| Business expenditure | Premises, staff, insurance, licences, substance and administration are additional |
Changes that require attention
Keep ownership, role, staff, premises and presence evidence current. A reduction below the approved ownership threshold, loss of the qualifying managerial job or withdrawal of the physical operation can affect eligibility. Inform the authority of material family and occupation changes and seek a variation where needed.
The purpose of the review is to align residence permission with a business that can actually operate. Banking, tax treatment, licensing and independent management should be settled together.
