Separate your departure from company closure
Leaving the UAE does not necessarily mean that a company should close. Decide whether the business will continue with real local management, move operational functions, or wind down. Each choice changes banking, licensing, accounting and tax tasks. Merely travelling abroad is not evidence that all company obligations ended.
Prepare the receiving country first
A move from the UAE into a worldwide-tax country can bring foreign companies and investments into a new tax system. Record asset values, retained profits, contracts and ownership before that date. Check whether your new home will regard the company as locally managed and whether foreign-company attribution applies. Obtain advice before making dividends, selling investments or moving intellectual property.
Close the practical loop
Check residence cancellation or continuing conditions, dependent permits, employer obligations, accommodation, utilities and insurance. Give banks accurate new address and tax-residence information. Review tax deregistration and final returns if a business ceases. The timing must follow actual facts; this page does not assume that a cancelled visa automatically ends every form of tax residence.
Separate the individual’s departure from the company’s future
Decide whether the business will remain in the UAE, be sold, be liquidated or move functions abroad. Each produces different contracts, registrations and tax questions. If it remains, identify who will make strategic decisions and how its licence, premises, staff, accounting and bank authority will continue. The departing owner’s new country may tax company management or attribute foreign profits even though the UAE registration stays in place.
If operations cease, obtain a closure plan from the relevant licensing authority, bank and tax adviser. Cancelling a licence should not be treated as a substitute for corporate-tax deregistration, final reporting or settling liabilities. Preserve records and an accessible correspondence address after departure.
Reconstruct the final residence period before making declarations
Compile your physical presence over the relevant twelve-month periods, housing arrangements, employment and remaining family or financial ties. UAE domestic residence can arise through more than the 183-day test; leaving for fewer than 183 days is not a universal nonresidence formula. A certificate already issued does not establish your residence for a later period.
The destination’s arrival rules may start before your UAE permit expires. Coordinate the start of employment, company management and significant investment transactions with that date. Tell banks and investment providers the actual change of address and tax residence, with supporting tax-identification information where required. Do not continue using an obsolete UAE address to support a tax position that no longer matches the facts.
Plan the administrative handover and continuing exposure
Create a departure file containing permit and identity records, tenancy closure, travel history, final payroll, company accounts and the official documents confirming any cancellation. Check the impact on sponsored family members before cancelling the principal’s status. Immigration cancellation and bank-product eligibility should be confirmed for the actual product and residence category, rather than assumed to move together.
A retained property, investment or company can create continuing UAE obligations after personal departure. Conversely, moving an asset or distributing a company’s profits may be taxable in the new country even if the UAE treatment is favourable. We do not describe the absence of a general personal income tax as a guarantee that a cross-border departure has no tax cost. The useful deliverable is a dated plan that identifies the taxpayer, transaction and country responsible for each obligation.
