An operating economy with international connections

South Korea can make sense for people with commercial, family or professional reasons to be there. It should be evaluated as an actual place to live and work, including language, healthcare, housing and the ability of family members to integrate. A banking relationship can be useful independently of a full relocation.

Establishment involves a sequence

InvestKOREA describes a foreign-investment process involving notification, funding, corporate registration, business registration and foreign-invested-company registration. These steps are not interchangeable, and an investment does not automatically answer the owner’s immigration or work-permission question.

Tax planning needs local detail

Residence, foreign-worker incentives, overseas companies and overseas financial accounts can each have distinct rules. The government identifies special support for qualifying foreign workers and engineers, but it should be assessed by category and effective date. This research draft does not assume that every foreign executive qualifies for a flat-rate election or that all overseas receipts are exempt.

A foreign investment is a regulated sequence, not simply a transfer

Invest Korea describes the general equity-investment framework as at least KRW100 million together with at least 10% of voting shares. Other recognised forms of foreign investment have different conditions. The capital belongs in a properly documented investment process; transferring personal living money into a Korean account is not the same event. Notification, remittance, registration and the foreign-invested-company record need to match.

A founder should prepare the ownership structure, intended activity, funding source and authority of the people signing. Ask the receiving bank how it wants the transfer identified and which documents it will issue. Establishment does not itself grant every person a work or residence permission. The actual executive or employee role must be matched to immigration requirements before work starts.

Banking works best when the local purpose is clear

A bank normally needs identity and evidence of the intended transactions. A residence card, Korean address and local employment or business documents help explain why the account exists. Before a residence card is available, ask which additional documents the branch accepts with a passport. A personal salary account, daily-expense account and corporate capital account should not share an improvised checklist.

Some accounts have restricted functions until the customer provides enough purpose evidence. Test mobile access, authentication, international transfer limits and name consistency before depending on the account for payroll or settlement. Prepare an accurate tax-residence declaration, including overseas identifiers when appropriate. Korean banking can be operationally useful, but it is not a universal remote offshore-account product.

Foreign-worker relief has defined eligibility and a trade-off

The foreign-worker election can apply a 19% national income-tax rate to qualifying employment income instead of ordinary treatment, subject to the statutory entry window and a twenty-year period measured from first qualifying work. The current provision covers commencement by 31 December 2026. It does not replace tax on every type of investment or business income and does not mean that all employment-related charges disappear.

The election also displaces normal exemptions, deductions and credits within its scope. Compare a complete ordinary calculation with the special calculation before electing. Related-party employers can disqualify a worker unless a specified exception applies. A founder working for a business they control should therefore not assume the election is available just because their passport is foreign.

Short-term foreign residents still need a source analysis

NTS distinguishes domicile or qualifying residence from nonresidence. A qualifying foreign national with no more than five years of Korean domicile or residence in the preceding ten years has a special limitation for foreign-source income paid or remitted to Korea. That rule does not turn remuneration for work in Korea into foreign-source income because the employer or bank is abroad.

Before moving, catalogue salary, dividends, business interests, pensions and investment income. Record the period to which each receipt relates and the residence history. A transfer may mix old capital and current earnings, so preserve evidence of both. The employer’s payroll settlement cannot be assumed to settle every personal tax obligation involving overseas assets.

A foreign company and a future departure require separate planning

Corporate Tax Act article 2 includes a company whose effective place of management is in Korea within domestic-company treatment. Separately, the international-tax statute can attribute a qualifying foreign company’s retained income to a Korean investor. Company residence and shareholder CFC attribution should be tested in that order rather than merged into a single offshore-company question.

A later departure can also bring a deemed disposal for specified substantial shareholders with the required residence history. Review this before establishing Korean residence if an eventual sale or relocation is part of the plan. Offshore Capitalist can connect the arrival, operating and departure work so immigration, banking and tax arrangements remain consistent with where the family and business actually function.
