Choose status for the real role

Determine whether the move is for employment, qualifying investment, family or another category. Immigration eligibility and the right to perform work should be confirmed before establishing the role in practice. A corporate investment can have notification and banking steps that need coordination with the visa process.

Review residence and international income

Korean residence rules consider domicile and a 183-day residence threshold. Residence is not established or avoided solely by the nationality of the payer. Foreign nationals may have special rules depending on their residence history; confirm the current conditions before remitting income or electing any foreign-worker treatment.

Prepare a usable local base

Check housing and address documentation, banking access, phone verification, insurance and local reporting obligations. Document overseas businesses and any powers retained over them. A person who continues to manage foreign companies from Korea needs a company-level review alongside the personal return. Family nationality and military-service consequences deserve separate attention where relevant.

Sequence notification, banking and business establishment

For an equity investment intended to qualify as foreign direct investment, confirm the applicable threshold and share rights before forming the entity. The common framework uses at least KRW100 million and at least 10% voting ownership, but it is not the only recognised form. Prepare investor identity, beneficial ownership, business purpose and lawful-source records.

Coordinate the notification and capital remittance with the bank, then complete the incorporation, business-registration and foreign-invested-company stages in the required order. Preserve the remittance evidence under the named investor. An undocumented transfer through another person or entity can complicate later proof. Review the individual’s immigration role separately and ensure family members have the permissions needed for their intended activities.

Set up banking around identity and transaction purpose

Prepare a passport, residence documentation and proof of the account’s actual purpose. An employer certificate or payroll evidence may support a salary account; corporate documents and signing authority support a business account. Confirm the branch’s requirements before visiting, including what is accepted while a residence card is pending.

Check that names match across identity, telephone and banking records. Ask whether the account will initially have limited functions and what evidence removes those limits. Test authentication and international payments with a small operational transaction before routing the business’s receipts through it. Record the required foreign-exchange documentation for capital contributions, loans and later dividends. These are separate transaction types, not generic bank transfers.

Complete the first-year tax and control review

Establish residence history over the prior ten years and identify which overseas income may fall within the short-term foreign-resident rules. Separate income earned by working in Korea from genuinely foreign-source receipts. Compare ordinary employment tax with any available foreign-worker election, including the related-employer restrictions and loss of deductions.

List every company, trust and substantial shareholding. Check effective management before applying CFC rules to a foreign entity, and retain the ownership and tax information needed for either analysis. If an eventual exit is likely, review the shareholder departure provisions now. A sound arrival plan anticipates both ongoing returns and the later sale or move, rather than treating the first visa or bank account as the end of implementation.
