Long-stay living with distinct programme choices
Malaysia can offer a practical regional base for households considering a longer stay. Federal MM2H has several categories with materially different deposit, property and fee commitments. State-specific programmes should not be assumed to share the same conditions. Work permission, permanent residence and citizenship are distinct from a long-stay social visit pass.
Budget beyond the deposit
A fixed deposit is tied-up capital, a participation fee is a cost and property is an investment carrying market risk. Add health cover, school fees, property maintenance and currency exposure before comparing Malaysia with another destination. A programme can be affordable on paper while tying up more liquid capital than expected.
Understand where income is earned
Foreign-income exemptions require a current technical review. Income from work performed in Malaysia should not be labelled foreign merely because the customer is elsewhere. The MM2H ministry’s headline descriptions of tax benefits should be reconciled with HASiL guidance and applicable exemption orders for the specific taxpayer and receipt.
Federal MM2H is a financial commitment and a residence permission
The federal Silver, Gold and Platinum categories combine fixed deposits, mandatory property purchases, fees and continuing conditions. Silver’s published minimums include a US$150,000 deposit and RM600,000 property; Gold uses US$500,000 and RM1 million; Platinum uses US$1 million and RM2 million. These amounts are not interchangeable with a single government fee. A fixed deposit remains an asset with restricted access, while a participation charge is expenditure.
The programme permits certain withdrawals for approved purposes after approval, subject to the current conditions. Do not assume the full deposit is freely available immediately or that the property can be sold whenever the family changes its mind. Federal, special-zone and state programmes must be compared separately. The linked MM2H guide explains category differences, documents and the staged process rather than blending their most attractive features.
Residence permission does not answer the right-to-work question
MM2H is not a universal employment pass. MOTAC distinguishes the activities available under different tiers, and the lower tiers should not be marketed as permission to carry on unrestricted local work. A business owner who intends to work from Malaysia must describe their actual role, employer, clients and activities and check the appropriate permission. An overseas company does not automatically make the work an overseas activity.
Family eligibility also needs to be tested precisely. Age, dependency and relationship conditions affect which children, parents or in-laws can be included. Prepare civil records and resolve name differences before filing. The main applicant’s approval is not sufficient evidence that every family member can live, study or work in the intended way. Health screening, insurance and passport validity can create separate practical deadlines.
Tax residence and foreign-income relief have different conditions
Section 7 includes the 182-day test, linked-year periods, a 90-day test combined with prior-year history, and a further continuity rule. Someone spending fewer than 182 days in a calendar year can therefore still be resident. MM2H’s immigration-presence conditions do not replace these tax tests. Count days with the relevant prior and following years in view.
The foreign-income exemption for qualifying resident individuals has been extended by Gazette P.U.(A)451/2024 through 31 December 2036, with the amendment commencing on 1 January 2027. The underlying conditions remain important, including the distinction between foreign income and work exercised in Malaysia. HASiL’s return notes explain the subject-to-tax condition and recognised situations in which foreign tax was not charged. This is not a tax holiday on all receipts entering a Malaysian bank account.
Review the business that moves with you
Company residence can turn on management and control exercised in Malaysia during the relevant basis year. A foreign company may therefore need review when its founder moves to Kuala Lumpur or Penang and continues making strategic decisions. The shareholder’s individual foreign-income exemption does not determine the company’s tax treatment. Map who controls budgets, financing, contracts, intellectual property and staff.
The implementation budget should also include property transaction costs, insurance, education, annual administration and any operating business costs. Confirm the bank’s requirements for opening and maintaining the qualifying deposit before transferring funds. Prepare an exit plan at the same time: leaving Malaysia, cancelling MM2H, releasing the deposit and selling property are distinct steps. Offshore Capitalist can coordinate these cross-border decisions and agreed implementation without assuming that one programme fits every household.
