What the tax system covers
Malaysia distinguishes local-source income and foreign income received in Malaysia. The current exemption for qualifying resident individuals' foreign income is conditional and does not transform work performed in Malaysia into foreign-source income. Residence rules include linked-year tests.
When you become tax resident
Malaysia taxes Malaysian-source income. Resident and nonresident status affects the treatment and availability of relief; the residence rules include more than a quick travel-day check. Work exercised in Malaysia needs a source analysis even when remuneration comes from abroad. Review HASiL’s 2026 ruling on foreign nationals exercising employment.
Rates and the tax base
0%–30% published resident scale. The cited table expressly covers YA 2023–2025. It remains the latest individual scale verified in this dataset; confirm the applicable later-year legislation before calculating 2026 or 2027 liability. Nonresident rates, dividends and special programmes differ.
Private investment gains and business trading
Individuals can be subject to real property gains tax on Malaysian real estate and real-property-company shares. The unlisted-share CGT introduced for specified entities is not a general individual capital-gains tax. A dealing business remains an income-tax question; distinguish private securities from property and trading stock.
Asset cost basis on arrival
Malaysia's capital-gains charges for foreign capital assets and specified unlisted shares apply to specified entities, not individual private investors. For an individual's ordinary private foreign shares, an immigration step-up is therefore not the source of the treatment.
Specified-entity CGT effective 1 January 2024; checked against amended guidance of 21 and 29 September 2026.
- Capital investment gains must be distinguished from gains taxable as trading or business income. This is not a blanket tax exemption for receipts brought to Malaysia.
- Individuals remain within real property gains tax for chargeable Malaysian property and relevant real-property-company shares. Residence alone does not remove that charge.
- The September 2026 CGT guidance concerns companies, LLPs, trust bodies and co-operatives; their exemptions, valuations and substance conditions cannot simply be applied to a person.
- No general arrival reset or foreign exit-tax credit is established for taxable exceptions in this record.
| Asset or situation | Starting value and treatment |
|---|---|
| Private foreign shares held personally | Outside the specified-entity CGT scope; confirm that the gain is capital rather than business income. |
| Malaysian property / relevant RPC shares | Separate RPGT can apply to individuals, resident or non-resident. |
| Assets held through a company or trust body | Different taxpayer scope; this personal comparison does not determine its CGT treatment. |
Foreign receipts need the current exemption conditions
Apply the operative exemption order by taxpayer and income category. P.U.(A)451/2024 extends the qualifying individual foreign-income exemption to 31 December 2036 with effect from 1 January 2027; older materials retaining the 2026 expiry should be read in that context. The subject-to-tax conditions and recognised exceptions remain material, and Malaysian-source employment is not transformed into foreign income by an overseas payer.
Apply all four section 7 residence rules
The familiar 182-day test is only section 7(1)(a). Section 7(1)(b) can link a shorter period to a consecutive 182-day period in the preceding or following year, with specific temporary-absence rules. Section 7(1)(c) uses at least ninety days in the current year plus the prescribed history in three of the preceding four years. Section 7(1)(d) considers residence in the following year and three preceding years.
Build a multiyear travel schedule rather than testing the current year alone. Record the reason for temporary absences where relevant. A person leaving in the middle of a year should not assume they become nonresident merely because the final day total is below 182. Immigration status, nationality and the tax tests are separate.
The enacted foreign-income extension does not remove the source test
The official amendment P.U.(A)451/2024 substitutes 31 December 2036 for the former 2026 expiry, effective from 1 January 2027. This explains why older official return materials still display 2026. Apply the exemption order’s substantive conditions as well as its dates. HASiL’s explanatory notes distinguish an individual’s eligible income from partnership income and discuss when foreign income satisfies the subject-to-tax condition.
Foreign income can meet that condition in specified circumstances even without a cash tax payment, including recognised features of the source country’s system. But an overseas payer does not establish foreign source. Public Ruling 2/2026 addresses foreigners exercising employment in Malaysia, including cross-border situations and relief. A remote worker should analyse where duties are performed before discussing a foreign-income exemption.
Deal with final employment income
HASiL identifies special timing treatment for employment income receivable after a permanent departure when the individual becomes nonresident in the following year. Obtain a breakdown of final salary, bonuses, benefits and equity-related amounts. Employer notification and tax-clearance responsibilities should be checked before payments and travel are finalised.
Arrange CP21 and clearance before the departure date
Where an employee is leaving for more than three months and the notification rules apply, the employer should submit the departure notification at least thirty days beforehand. HASiL’s guidance explains the withholding of amounts due while clearance is addressed, with exceptions for certain frequent travel in the course of employment. Plan the move’s cash flow around the actual release process.
Compile final salary, bonuses, benefits and equity-related amounts. HASiL also describes special treatment for employment income receivable after permanent departure where the person is nonresident in the following year. Obtain the exact calculation and reporting treatment rather than assuming that later payment makes the income foreign or moves it outside the departure-year return.
Residence can persist through linked-year rules
Review all section 7 tests using current, prior and subsequent-year travel. A departure-year day count below 182 is not a complete conclusion. Retain evidence of the new home and work location, the end of Malaysian duties and any continuing business or property arrangements. Where two countries claim residence, examine the relevant treaty rather than choosing whichever address appears on a bank statement.
Update correspondence and bank tax-residence information accurately. Closing a Malaysian tax file requires the appropriate process and resolution of outstanding tax or refunds; it is not achieved merely by cancelling a pass. If Malaysian-source income continues, arrange ongoing filing and a reliable contact for notices.
Foreign companies and income attribution
Current CFC scope not verified. Malaysian management and source rules cannot be replaced by a foreign company label.
Departure, migration and continuing obligations
Personal employment CP21/clearance and linked-year residence tests matter. Company residence, closure and retained local operations need separate review.
