Residence is a home-and-presence analysis

A Czech home available in circumstances showing an intention to live there, or habitual presence of at least 183 days in the calendar year, can establish domestic residence. Count each commenced day for the day-count test. A residence card, company registration or correspondence address does not replace this tax analysis.

Where another country also treats you as resident, read the applicable treaty tie-breaker and the facts supporting it. The Financial Administration’s 2026 methodology addresses split-year situations; the home test and annual presence test can interact differently. Do not assume that arriving after a particular date automatically shelters foreign income for the rest of the year.

Keep the lease or home record, travel history, location of spouse/children, work arrangements and foreign residence certificate. These documents explain when the facts changed and help the two advisers reconcile their returns.

2026 annual income-tax bands

The ordinary annual schedule is 15% on the tax base up to CZK 1,762,812 and 23% on the excess. The higher rate is marginal. The monthly payroll threshold is CZK 146,901; that is an advance-tax calculation, not a separate annual bracket. Deductions, tax-base rounding and credits must be applied in the correct order.

The basic taxpayer credit is CZK 30,840 a year. Other family, disability or retirement-related items have their own conditions. A nonresident cannot simply assume all resident credits are available. Czech municipal budget shares of national income tax are not an additional city income-tax rate.

Excess over CZK 1,762,81223% on the excess

A salary example that separates tax from contributions

Consider a hypothetical full-year ordinary employee with CZK 1,200,000 cash salary, all of it taxable and insured, the basic taxpayer credit and no other deductions or credits. Income tax is CZK 180,000 less CZK 30,840, or CZK 149,160. Employee social insurance at 7.1% is CZK 85,200 and health insurance at 4.5% is CZK 54,000. The resulting annual cash amount is CZK 911,640.

The employer’s ordinary social contribution at 24.8% is CZK 297,600 and health contribution at 9% is CZK 108,000, giving a salary-plus-these-contributions subtotal of CZK 1,605,600. This is an arithmetic illustration, not a payslip calculator: sector risks, insurance, benefits, leave and other contractual costs can add to it. Cross-border insurance coordination can change which system applies.

Asset cost basis on arrival

Ordinary taxable private disposals use acquisition cost or the applicable statutory acquisition value. Holding-period exemptions can eliminate the taxable sale altogether. A specific Canada–Czech treaty election can reset qualifying assets to pre-arrival market value after Canadian deemed-disposal taxation.

From 1 January 2026 the CZK40 million cap was removed for holding-period-exempt securities and company-participation income. The crypto cap was not removed. This change affects exemption, not immigration basis.

  • Check whether the sale is exempt before calculating its basis. A three- or five-year holding-period exemption is different from a revaluation on becoming Czech resident.
  • The Canada treaty exception requires an immediate move between treaty residences and a deemed disposal taxed by the former state. It is an election, not an automatic reset for every newcomer or every Canadian citizen.
  • The treaty excludes property whose gain could already be taxed by the destination state immediately before arrival and immovable property in a third state. Applicable treaty residence and anti-abuse conditions remain relevant.
  • The local procedure, deadline and evidence accepted for an Article 13(8) election have not been verified here. Obtain written confirmation of the filing treatment before relying on it.
  • Section 23g's incoming EU exit-tax asset rule belongs to the corporate-income-tax framework; it should not be presented as a universal step-up for an individual's private portfolio.
Asset or situationStarting value and treatment
Purchased private securities and ordinary fund unitsIf taxable, section 10(5) uses acquisition/purchase cost under the applicable securities rules and permits specified transaction costs. First test the securities exemption and legal classification of the fund.
Non-security company participationsSection 10(6), read with section 24(7), uses the participation's acquisition basis, including relevant contribution and reorganization adjustments. The ordinary holding-period test is separate.
Private property and previously business/rental assetsSection 10(5) generally starts with the demonstrable purchase price; it also addresses improvements and disposal expenses. Previously depreciated business/rental property can require residual tax value.
Gifts and inheritanceFor covered gratuitous acquisitions, section 10(5) or section 24(7) uses the statutory valuation at acquisition. This is a gift/inheritance acquisition rule, not a later reset when the recipient immigrates.
Eligible Canada-to-Czech moveArticle 13(8) permits an election for qualifying property to be deemed sold and reacquired immediately before Czech residence at fair market value, following the former-state deemed-alienation tax. Excluded assets, residence continuity, the PPT and local implementation must be checked.

Test the exemption before calculating the gain

Czechia separates two questions: whether the disposal is taxable, and which cost can be deducted if it is. This matters when you arrive with assets acquired years earlier. The ordinary holding-period tests refer to acquisition and disposal; they are not a general instruction to restart ownership when you immigrate.

From 1 January 2026, the CZK40 million cap on the holding-period exemption for securities and company participations was removed. The remaining crypto cap must not be applied to shares, and the share reform must not be applied to crypto.

  • A five-year kmenový list rule should not be mistaken for the ordinary three-year securities test.
  • Keep purchase dates, costs, valuation reports and the history of reorganizations.
  • Treat foreign exit tax and an available treaty election as a separate review; neither follows merely from the holding-period rules.
HoldingExemption checkIf the disposal is taxable
Ordinary private securitiesGenerally more than three years; alternatively check the separate CZK100,000 annual gross-proceeds test. Business-asset, forward-sale and instrument exceptions apply.Section 10(5) uses the applicable acquisition cost and specified transaction expenses.
Company participation not represented by a securityGenerally more than five years, with exceptions and contribution/reorganization provisions.Section 10(6) and section 24(7) determine the participation's acquisition basis.
Fund unitsCheck whether the interest falls within the securities rules; specified fund-liquidation proceeds also have a three-year test.Apply the appropriate securities cost rule, rather than assuming every foreign fund is treated identically.
Gift or inheritanceCheck the receipt and sale exemptions separately. The securities/participation holding tests can include the deceased's ownership period for specified direct-line or spousal inheritance.Covered gratuitous acquisitions use valuation under the statutory valuation framework at acquisition; immigration is a different event.
Previously depreciated rental/business propertyProperty exemptions and business-use exclusions need their own assessment.Residual tax value can replace original price; the private-investor summary is not a depreciation schedule.

Moving from Canada: a specific treaty election

Article 13(8) of the Canada–Czech treaty is a real exception to the ordinary acquisition-cost position. It can allow qualifying property to be treated as sold and reacquired at fair market value immediately before the person becomes resident in the other state.

The Czech Ministry of Finance's MLI notice lists changes to the treaty's preamble, anti-abuse provisions and mutual-agreement deadline; it does not list a change to this election. Treaty residence and the principal-purpose test still matter. A Canadian passport alone does not establish eligibility.

  • Keep the Canadian departure return, deemed-disposal computation and evidence of its tax treatment.
  • Document the residence transition and the assets included or excluded.
  • Obtain confirmation of how the Czech election is made before a disposal relies on the adjusted value.
ConditionWhat must be established
Residence changeThe person ceases to be resident of one contracting state and immediately becomes resident of the other.
Departure taxationThe first state treats the property as alienated and taxes the person by reason of that deemed alienation.
Asset eligibilityExclude property whose gain immediately before arrival could be taxed by the destination state; exclude immovable property in a third state.
ElectionThe treaty says the individual may elect. Do not describe the result as automatic.
ValueEstablish fair market value immediately before becoming resident, with supporting asset-specific evidence.
Local implementationConfirm the Czech procedure, deadline, return presentation and any interaction with domestic exemption/holding rules. Those procedural points have not been verified in this guide.

Investment type and holding history matter

For 2026, the CZK 40 million cap on the time-test exemption for securities and ownership interests has been removed. Qualifying securities generally use a three-year holding test and non-security company interests a five-year test. A kmenový list representing an ownership interest uses five years rather than the ordinary securities period; business-asset and transaction-specific exceptions remain. The separate CZK 100,000 securities proceeds test is about aggregate disposal receipts, not net profit.

Crypto should not be merged into the same row. Its time-test regime retains the CZK 40 million cap, and eligibility and excluded assets must be checked. A sale after relocation may also remain taxable in the departure country. Reconstruct purchase dates, cost, ownership history and currency conversion before relying on a Czech exemption.

Where an exemption does not apply, the gain belongs in the appropriate taxable-income category. Do not confuse a domestic dividend withholding treatment with an exemption for all foreign dividends or with the sale of the underlying shares.

IssueWhat matters
SecuritiesThree-year time test or qualifying aggregate-proceeds test; review statutory exclusions.
Non-security company interestOrdinary five-year time test with exceptions; 2026 cap removal matters.
CryptoassetsSeparate rules; retained CZK 40 million time-test cap.
Dividends/interestPayment-specific withholding or return treatment; foreign income needs treaty/credit review.
PropertySeparate occupation/holding/use-of-proceeds rules; not the share exemption.

Asset values on arrival: preserve the original file

A valuation at the date of moving is useful evidence, but it should not be treated as an automatic tax-cost reset. This research does not establish a general immigration step-up for every private asset. The ordinary sale rules, holding-period exemptions, acquisition method and any interaction with a foreign departure charge require asset-by-asset checking.

Before moving, retain acquisition contracts, broker statements, evidence of corporate reorganisations, inheritance or gifts, and any foreign exit-tax computation. If you plan a substantial sale shortly after arrival, settle both the exemption analysis and the deductible basis in writing before executing it.

The flat-payment regime is conditional

The current monthly payments for the three bands are CZK 9,162, CZK 16,745 and CZK 27,139. They combine income tax, pension insurance and health insurance. They are not three alternative rates that any consultant may freely select. The first band fell from CZK 9,984 from July 2026; a January rate sheet is therefore insufficient for current payments.

A taxpayer who paid CZK 9,984 in each month from January through June has a CZK 4,932 overpayment under the retrospective adjustment. The tax authority allows this to reduce a later 2026 advance; if unused, a refund may be requested after the year. Reconcile the actual account rather than deducting the full amount when fewer or different payments were made.

The correct band and eligibility depend on revenue, the type and mix of activity, VAT status and other income or employment. A new arrival with a foreign employer, portfolio disposals or a company-director role needs that whole picture checked. Flat payments also do not eliminate records demonstrating continued eligibility. Outside this regime, the July 2026 change to minimum self-employed pension advances has its own calculation and refund procedure.

A foreign company remains a separate question

The tax authority expressly limits the Czech ATAD CFC provisions to corporate-income-tax taxpayers and excludes natural persons from those provisions. That narrow finding does not make foreign-company money tax-free to an individual. Salary, dividends, transparent-entity income and anti-abuse provisions must still be analysed.

In addition, a foreign entity may itself become Czech-resident through its place of management, or have Czech taxable business activity. For an owner who makes all commercial decisions from a Czech home, the corporate-residence question can be more immediate than personal CFC attribution.

Prepare a return that can be reconciled

Collect annual employer confirmations, foreign tax assessments, investment transactions, rental accounts and proof supporting deductions. Separate amounts already subject to final domestic withholding from income requiring return treatment. The filing method and whether a qualified adviser or audit is involved can affect the deadline; use the authority’s calendar for the particular year.

We can help review the cross-border facts and coordinate the agreed analysis with the people preparing the relevant returns. The useful starting point is a complete income-and-assets inventory, not a headline rate applied to everything.
