Residence is not nationality

An occupation permit, property-linked residence, a 20-year PRP and the Golden Visa are immigration permissions. None automatically confers Mauritian nationality. Citizenship requires a separate statutory route, evidence and decision; the investment condition for one residence route should never be advertised as an automatic passport price.

For an application, identify whether the person is a Commonwealth citizen, an alien as defined by the Act, a qualifying spouse, a child or someone with an existing birth/descent claim. The relevant residence periods and legal mechanism differ.

Ordinary residence routes

Commonwealth citizens apply for registration under section 5. The ordinary requirement is five continuous years of residence immediately before application, alongside character, language/knowledge and intention to continue living in Mauritius. The Minister has a statutory special-circumstances discretion to accept a shorter period of at least twelve months; it is not a published shortcut anyone can demand.

For an alien or British protected person under section 9, the ordinary test is twelve continuous months immediately before application, plus at least five years in aggregate during the seven years before that twelve-month period. Character, knowledge of English or another language current in Mauritius, citizenship responsibilities and continuing residence are also relevant.

Sections 5 and 9 exclude a holder of the specific temporary-residence-permit category under the Immigration Act 2022. Do not equate every time-limited occupation permit with that statutory category: establish exactly what permission was held and which periods can count.

The investor provision is discretionary naturalisation

Section 9(3) permits the Minister to accept at least two continuous years of residence in place of the ordinary section 9 residence periods where the applicant has invested at least USD 500,000, or another prescribed amount. It does not waive the other applicable criteria, eliminate physical residence or guarantee a decision after two years.

This provision differs from the USD 100,000 occupation permit, property residence above USD 375,000 and the USD 1m Golden Visa. The legal eligibility of a proposed investment, the applicant’s nationality category and the evidence should be confirmed before committing capital in reliance on citizenship.

Marriage and children

The foreign-spouse route generally requires living with the Mauritian spouse under the same conjugal roof in Mauritius for at least four years immediately before application. Section 7 contains additional rules where a temporary residence permit is converted to a residence permit; the residence history must be examined rather than counting only the wedding anniversary.

A child’s position depends on parentage, the date and place of birth, the parent’s nationality basis and any applicable adoption or registration rule. The authority states that birth in Mauritius after 1 October 1995 requires a Mauritian parent for the ordinary birth claim, and its overseas-descent guidance refers to a parent Mauritian by birth. Do not promise unlimited transmission through successive foreign-born generations.

Mauritius does not recognise domestic same-sex marriage or civil partnership in the current official civil-document guidance. The OP dependent rules expressly refer to an opposite-sex common-law partner. A foreign marriage certificate should not be assumed sufficient for a same-sex dependent application without a written route-specific determination; each partner may need an independent route.

Multiple nationality needs a route-specific opinion

Mauritius has allowed dual nationality since the 1995 reform, and the former automatic loss at age 21 is not a current general rule. However, the Citizenship Act retains section 12 concerning foreign-national rights of registered or naturalised citizens and section 2(2)(d) dealing with circumstances where required renunciation is not permitted abroad.

Those provisions prevent a responsible adviser from giving every naturalisation applicant an unqualified promise that all existing nationalities can be retained and exercised without consequence. Review the particular route, original nationalities, application declarations and current administrative practice with the citizenship authority. This guide deliberately marks the outcome as conditional rather than universal.

Prepare the file and understand the decision stage

Build a residence chronology backed by permits, entry/exit records, homes and the evidence relevant to the chosen route. Add civil records, character evidence, language/knowledge and investment documents where applicable. The official naturalisation procedure requires the prescribed application to be subscribed before an authorised judicial officer and notices in two daily newspapers.

The authority’s linked fee notice lists an MUR 2,000 application fee and MUR 50,000 certificate fee for naturalisation/Commonwealth registration, with different fees for spouse/minor categories and additional witnessing/oath charges. It is a historic notice still linked by the current page, so confirm the requested amount before payment. No reliable current overall decision-time guarantee has been established.

Act 13/2026 section 35 removes the no-reasons wording in section 7(3) and repeals section 11(8). Older summaries that reproduce those powers without the 2026 amendment are incomplete. A decision remains subject to the applicable statutory process; meeting a residence period is an eligibility milestone, not an issued passport.
