Start with how you want to live
A remote worker planning a year abroad, a retired couple and a founder relocating a company need different arrangements. Costa Rica has distinct routes for those circumstances. Their income evidence, work permissions and longer-term consequences should not be treated as interchangeable.
Before choosing a property or booking a one-way flight, decide whether the project is a temporary stay or the start of an established home. Then test healthcare, schooling, travel, banking and the business operating model against that decision.
The main residence choices
The remote-worker programme is a special stay category for qualifying services delivered to people or businesses outside Costa Rica. Pensionado and rentista are income-based temporary-residence categories. Investment residence has its own qualifying-asset and valuation rules.
Law 8764 permits an application for permanent residence after three consecutive years of temporary residence, subject to its conditions. Do not assume that time in a special digital-nomad stay counts in the same way.
A date-sensitive investment issue
Law 9996 introduced a USD 150,000 investment range and incentives. Its benefits have a five-year entry window, and the investment provision itself refers to the law’s period. Because the original law dates from July 2021, an October 2026 applicant needs confirmation of the operative threshold and any extension. Our programme guide flags this instead of advertising an unverified current discount.
Tax residence requires its own analysis
Law 9996 expressly says the investor, pensionado or rentista classification does not automatically establish tax residence. Conversely, work performed locally can matter even if customers and payment accounts are abroad. Assess the source of each income stream and the countries in which the owner and company remain taxable.
Build the move in the right order
Identify the route, collect time-sensitive documents, align the departure plan, and then complete local registration and renewal tasks. We can help coordinate those steps and compare Costa Rica with alternatives based on how you actually live and operate.
Choose a category that matches how you earn
A remote worker providing paid services to customers or an employer outside Costa Rica may qualify for the digital-nomad estancia. The detailed government checklist requires USD 3,000 monthly income, or USD 4,000 when including dependants, supported by the preceding year of receipts. This category is a temporary stay with a particular remote-work purpose.
Pensionado and rentista are different categories under the general migration law. Pensionado requires a stable permanent foreign pension of at least USD 1,000 monthly. Rentista requires stable permanent monthly income of at least USD 2,500 from abroad or banks in the national system. A person with savings but no documented qualifying income should not assume that an account balance answers either test.
Duration, family and work rights are separate decisions
The general temporary-residence framework allows grants exceeding ninety days and up to two years, renewable. Article 78 allows an application for permanent residence after three consecutive years of temporary residence. The digital-nomad estancia is a different legal category, so its one-year grant and one-year renewal should not be presented as the same route to permanence.
Article 80 restricts temporary residents to the paid or profitable activities authorised by immigration. Dependants also need the appropriate authorisation to work. A family planning to operate a local tourism business, take employment or serve Costa Rican clients must check those activities separately from the principal’s income qualification.
The 2021 investment incentives need a current-law check
Law 9996 introduced a USD 150,000 investment threshold and specific import, qualifying-income and property-transfer benefits. Its wording contains a five-year entry window from publication in July 2021, with a ten-year benefit period for those who entered in time. On this research date that initial entry window has elapsed.
The published consolidated text reviewed did not establish a verified extension for new October 2026 cases. Before buying an asset or budgeting an exemption, obtain confirmation of the operative investment threshold, the treatment of a pending case and whether any incentive remains available. Existing beneficiaries and new applicants are different categories.
Local business income does not inherit a blanket exemption
Law 9996 expressly preserves income tax on income generated in Costa Rica from local investments. It also states that holding the qualifying immigration category does not automatically make the holder a tax resident. These are distinct questions even where a particular qualifying income enjoys an exemption.
For a founder, map work location, customer location, employees, invoicing and distributions. Digital-nomad treatment concerns the approved remote-worker arrangement; it should not be transferred to an unrelated local company or to income outside the programme. Departure from the current country must be established under that country’s rules as well.
Renewal is an ongoing evidence obligation
General temporary residents normally need continued qualification and uninterrupted applicable CCSS insurance for renewal. Budget social-security participation and maintaining the income evidence, rather than viewing the initial permit fee as the entire cost of residence. Changes to pension, income source, family or activity can affect the next application.
Digital nomads instead have a specific renewal checklist, including proof of at least eighty days in Costa Rica during the first grant, continued qualifying foreign income and medical cover for the authorised stay. Save travel and income records as they arise; reconstructing them at renewal creates unnecessary delay.
Citizenship requires a sustained, documented connection
The standard naturalisation route uses five years of official residence for Central American, Ibero-American and Spanish nationals by birth, and seven years for other nationalities. Language, civic knowledge, livelihood and good-conduct evidence matter alongside the years. The Electoral Tribunal publishes a 285-working-day resolution period for the naturalisation procedure itself.
The practical sequence is therefore immigration qualification, maintaining the status and residence evidence, naturalisation preparation, and a separate government decision. It is unsuitable for someone seeking an immediate second passport with little connection to the country. Offshore Capitalist can compare a genuine Costa Rican move with alternatives before any investment is committed.
