Eligibility & suitability
Who can qualify
- Applicants with a permanent stable foreign pension meeting the statutory USD 1,000 monthly minimum.
- Eligible family members whose relationship and documentation satisfy the current rules.
Restrictions & unsuitable cases
- Applicants relying solely on savings, business turnover or an income source that does not qualify as a pension.
- People seeking unrestricted local work without the necessary authorisation.
Application process & timeline
The pension qualification is statutory. No current government end-to-end processing estimate was verified for this guide; document preparation, adjudication and card issuance are separate stages.
01Verify the pension entitlementBefore ordering the final application documents
Review the institution’s award and payment evidence against the permanent, stable USD 1,000 monthly requirement. Identify family members and any work the principal expects to continue.
Documents & evidence
- Pension award or institution certificate
- Recent receipt statements
- Family schedule
- Savings withdrawals and company distributions are not automatically pensions.
- Temporary additions to a pension may not establish stable entitlement.
02Assemble the identity and residence filePreparation varies by issuing country
Use the current immigration checklist to determine the civil and background records for each applicant, their validity periods and required authentication. Prepare official Spanish translations and the authority to act where represented.
Documents & evidence
- Passport
- Required civil and background certificates
- Authenticated pension proof
- Translations and representative authority
- Ordering documents too early can cause expiry before filing.
- Names and birth details must agree across certificates.
03File the temporary-residence applicationAfter a complete file is ready; no verified fixed wait
Submit through the authorised consular or immigration channel, with current payment receipts and contact details. Keep a copy and proof of filing, and confirm the applicant’s lawful position while it is considered.
Documents & evidence
- Signed application
- Complete supporting file
- Current required fee receipts
- An application is not permission for unrestricted employment.
- A filing receipt should not be treated as an automatic travel document.
04Answer requests and obtain a decisionGovernment review varies; no verified service target stated
Respond to any request to explain the pension, family or documents. Review the actual approval for the grant duration and any conditions rather than assume every temporary grant lasts the maximum period.
Documents & evidence
- Supplementary evidence if requested
- Approval resolution
- Pension changes during processing should be disclosed and assessed.
- Do not book an irreversible move around an unsupported processing estimate.
05Complete resident documentation and insuranceAfter approval, within the resolution’s requirements
Complete the required resident-document procedure and applicable CCSS enrolment. Record the status start date, expiry and renewal evidence needed for the next application.
Documents & evidence
- Approval
- Original identity documents
- Applicable insurance and payment evidence
- Approval and card issuance are separate milestones.
- Insurance continuity matters at renewal.
06Renew or apply for permanent residenceBefore expiry; permanence after three consecutive temporary-residence years
Maintain the qualifying conditions and insurance, and submit the appropriate renewal or category-change file. Review any change in work, family or tax residence before relying on the next status.
Documents & evidence
- Current pension proof
- CCSS continuity evidence
- Residence and family records
- Permanent residence requires an application; it is not automatic on the third anniversary.
- Immigration residence does not by itself terminate tax residence abroad.
Document checklist
Track your preparation in this browser. Final requirements depend on the route and filing authority.
Eligibility begins with the pension
Article 81 of the General Migration Law requires a permanent, stable foreign pension of at least USD 1,000 monthly or its equivalent. The character of the payment matters: a savings balance or discretionary investment withdrawal is not necessarily a qualifying pension.
The authority needs reliable evidence of the entitlement, payer and amount. Ask the pension institution for the required wording before arranging authentication, because a statement showing one payment may not establish the continuing entitlement.
A practical application file
Prepare current identity documents and the pension evidence alongside the background and civil records required by the current immigration checklist. Family members require proof of their relationship and eligibility. Names, birth dates and changes of surname should reconcile across the file.
Foreign public documents may need an apostille or legalisation and official Spanish translation. Obtain the current category checklist before ordering documents with limited validity. Submission, approval and local identity documentation are separate stages.
What to budget and maintain
The USD 1,000 figure is a monthly-income qualification, not a government payment. Government charges, document procurement, translation, local assistance and health or social-insurance obligations must be budgeted separately.
Temporary residence is renewable subject to continuing qualification. Check the approval, applicable absence rules and CCSS requirements rather than assuming that a residence card can be maintained indefinitely without attention. Law 8764 provides a potential permanent-residence application after three consecutive years of temporary residence; it is not an automatic conversion.
Do not base the move on expired incentive advertising
Law 9996 contains tax and import incentives with a five-year entry window beginning in 2021. Eligibility for a new application after that window, any extension and protection for an existing beneficiary need checking. Pensionado immigration permission and a particular tax concession are distinct questions.
How it fits the broader plan
Assess the pension’s treatment in its paying country, Costa Rican residence and other income before relocating. A retired founder may still own companies or direct investments. We can help coordinate those issues and the practical application without treating pensionado status as a blanket tax exemption.
The qualifying payment must be a pension
Article 81 requires a permanent, stable monthly pension from abroad of at least USD 1,000 or its equivalent. The source document should identify the recipient, pension institution, amount and the continuing character of the entitlement. A business dividend or a planned withdrawal from savings should not simply be renamed a pension.
Where the payment fluctuates with exchange rates or includes temporary supplements, analyse the dependable qualifying amount. A foreign pension award and the statements showing receipt serve different purposes: one establishes entitlement, the other supports actual payment. Obtain the evidence in the form accepted by immigration before translating it.
The budget extends beyond the residence application
The income threshold is money available to support the applicant, not a government contribution or an investment that must be donated. The application still creates document, translation, immigration and professional costs. Applicable CCSS enrolment and contributions should be budgeted as continuing obligations.
The published law requires uninterrupted applicable CCSS insurance for renewal from the time residence is granted. Pension evidence and family eligibility must also remain supportable. Confirm the current administrative charges and any guarantee requirements for the particular file; this draft does not substitute an unverified flat government-fee package.
Consider work plans and the long-term residence route
Temporary residence does not give unrestricted permission for paid work. Article 80 requires immigration authorisation for the remunerated or profit-making activities undertaken. A retired founder who still directs an operating business should describe the real work before choosing this category.
After three consecutive years of temporary residence, the law provides a route to apply for permanence. Citizenship requires a separate longer residence period and other qualifications. The 2021 incentive law’s entry window and continuing benefits for existing beneficiaries must be checked independently; do not budget new import or income exemptions without confirming availability.
