Who this route is for
This route addresses a third-country national whose genuine purpose is conducting business in Poland. It can cover an eligible sole trader and relevant roles in companies, including certain shareholder-directors, general partners or commercial proxies. The exact role and business form matter: an employed manager without the relevant ownership relationship may need a different work route.
The permit is not purchased by incorporating a company or placing a minimum sum in its bank account. The authority examines the business case as well as the applicant. A new venture can use the statutory future-capacity branch, but it must demonstrate a credible path supported by funds and concrete activity. A generic business plan with unsubstantiated sales projections is weak evidence.
The three economic-evidence branches
The prior-year income benchmark is tied to the applicable voivodeship’s official average remuneration, not a single nationwide investment price. Use the exact regional published measure for the application year and the statutory income concept. Revenue, paid-in capital and profit cannot be substituted for one another without analysis.
The employment alternative concerns qualifying workers on full-time, indefinite contracts over the prescribed preceding period. A newly signed contract does not establish a year of qualifying employment. Where neither historical branch is met, evidence of sufficient resources and actions likely to achieve the conditions is critical: real customer commitments, funded investment, technology transfer, innovation or job creation should be supported rather than merely asserted.
| Branch | Evidence focus | Frequent mistake |
|---|---|---|
| Prior-year income | At least 12 times the applicable official regional average remuneration measure | Using turnover instead of statutory income |
| Employment | At least 2 qualifying employees, full-time indefinite employment for the preceding 12 months | Assuming any contractors or recent hires satisfy it |
| Prospective capacity | Resources and concrete steps capable of meeting the economic conditions | Treating an unfinanced plan as sufficient |
The owner’s file is separate from the company’s file
Prepare lawful-stay evidence, identity, health coverage and the required personal support/housing evidence alongside the business records. A solvent company does not automatically establish an applicant’s personal resources. Show the legal basis on which funds or remuneration reach the applicant and reconcile it with tax and social-insurance records.
The route can be granted for a period of up to three years according to its conditions, rather than an automatic three-year award. It is not automatically renewed. Continued business purpose, economic evidence and timely applications remain important. A spouse’s or child’s permission requires its own qualifying family route; the owner’s approval alone does not place every family member in lawful residence.
For ordinary family reunification through successive temporary permits, the sponsor generally needs at least two years of residence on those permits; the permit held immediately before the family application must have been granted for at least one year. This gate concerns both a spouse and a qualifying minor child. Blue Card sponsorship is a separate statutory category. Other child, humanitarian and EU-law routes require their own assessment.
Electronic filing does not remove attendance
The current business procedure uses MOS while the applicant is lawfully in Poland. Prepare the digital identity/signature, required photo, passport pages, payment and supporting evidence, then retain the official submission receipt. Do not mistake an incomplete application draft for a filing made before lawful stay expires.
A qualifying timely application can preserve lawful stay under the applicable rules, but that is not a new visa, a general Schengen travel document or an unconditional right to re-enter Poland. Follow the voivodeship’s requests for biometrics and originals. Plan essential travel around the actual document held, not an expectation that a pending application will be treated as a residence card at the border.
For an application based on serving as a shareholder-director, managing a partnership as a general partner or acting as a commercial proxy, the work-providing entity must complete and electronically sign the required employer annex in MOS. Confirm the company’s authorised signatories and any powers of attorney early: the applicant cannot finish submission without the required annex. Check applicability separately for a sole proprietor.
Evidence that should survive the application
Accounts and tax filings should reconcile with bank activity, payroll and the business plan. Keep registrations, ownership records, customer/supplier agreements, premises evidence and any regulated-activity permission accessible. For the employment branch, preserve contracts and contribution histories covering the required period, not just a current headcount screenshot.
Immigration viability is only one part of the design. The company still needs a defensible tax residence, VAT treatment, payroll and annual compliance process. Our role can cover the planning and coordination of these workstreams with the appointed professionals; legal representation, government decisions and banking acceptance remain separately scoped.
