Employment, a service contract and a sole trader are different
Begin with the actual relationship: the work, supervision, working pattern, contractual form and applicable law. A person invoicing through a sole-trader business does not necessarily have the same contribution base or employment rights as an employee. This guide’s percentage table covers the ordinary employee starting point; it is not a self-employed calculation or a net-pay calculator.
For a foreign hire, immigration permission and the right to perform the intended work must be established before the start date. For cross-border staff, determine which country’s social-security system applies and whether an A1 certificate or treaty position changes the domestic starting point. An overseas employer can have Polish obligations without first incorporating a subsidiary.
2026 contributions: who pays and what stops at the cap
The 2026 annual pension and disability assessment ceiling is PLN 282,600. It applies to those two contributions, not as a blanket exemption from all charges on earnings above it. Multiple employments and earnings earlier in the year must be considered when applying the cap. Health uses the employee base after the relevant employee social deductions.
Accident insurance is employer-funded and depends on the employer’s category and assigned calculation; the official general activity-group rates span 0.67% to 3.33%, but an individual employer’s correct rate must be established. Labour Fund/Solidarity Fund and guaranteed-benefits contributions have their own conditions and exemptions. Additional pension or disability-employment obligations can apply, so adding a single fixed percentage to gross salary is not a complete employer-cost model.
| Ordinary employee item | Employee | Employer | 2026 base / qualification |
|---|---|---|---|
| Pension insurance | 9.76% | 9.76% | Combined annual assessment ceiling PLN 282,600 |
| Disability insurance | 1.50% | 6.50% | Same pension/disability assessment ceiling |
| Sickness insurance | 2.45% | — | No 30-times annual pension/disability ceiling |
| Accident insurance | — | Employer-specific | Risk/category rules; do not assume a universal 1.67% |
| Health insurance | 9% | — | Adjusted employee base; no pension/disability annual cap |
| Labour/Solidarity funds | — | Normally 2.45% combined | Exemptions/eligibility must be checked |
| Guaranteed Employee Benefits Fund | — | Normally 0.10% | Employer/category exemptions can apply |
| PPK basic payments if participating | Normally 2% | Normally 1.5% | Separate pension-saving rules; opt-out/reduced/extra contributions can change the result |
PPK and payroll records
PPK is a separate funded retirement-saving arrangement. The basic employee payment is normally 2% and the basic employer payment 1.5%; lower-income employee reductions, additional payments and opt-outs require their own checks. Automatic enrolment ordinarily concerns the statutory employed-person category aged 18 to under 55, not every person who receives a payment from the business.
Keep the employee’s declarations, eligibility dates and pay-base history with the payroll file. A comparison should show income tax, employee social insurance, health, PPK and employer-only costs separately. A deduction from the employee’s pay and an employer expense may have different tax consequences. Benefits, bonuses, sick pay, cross-border periods and multiple jobs need the appropriate calculation rather than reuse of a simple salary example.
Minimum pay and working time
From 1 January 2026 the national minimum monthly salary is PLN 4,806 for full-time employment. The separate PLN 31.40 minimum hourly rate concerns specified civil-law contracts; it should not be presented as a universal statutory hourly rate for all employees. Check which components count toward the applicable floor and adjust for the correct contract and working-time basis.
The basic Labour Code norm is eight hours a day and an average 40-hour week over an average five-day working week in the reference period. Alternative systems, overtime, rest and night-work rules need their own treatment. Remote work does not remove these obligations. Agree how hours, overtime approval and required records will be handled before a distributed team begins work.
Annual leave and the 2026 service-history change
The ordinary annual-leave entitlement is 20 days below ten years of counted service and 26 days from ten years, with proportionate treatment for part-time employment. Qualifying education and earlier periods can affect the service calculation. Do not ask only how long the person has worked for the current employer.
The 2026 reform expands counted service for qualifying documented non-employment activity, including relevant self-employment and civil-contract periods. It applies from 1 January 2026 in the public sector and 1 May 2026 in the private sector. Obtain the required evidence and avoid double-counting overlapping periods. An employee’s entitlement may therefore change even though their current employment contract has not changed.
National payroll rules and local operating costs
The PIT schedule and listed social-insurance rules are national. Choosing Warsaw rather than Kraków does not create a different municipal PIT bracket in this comparison. Municipal property taxes, premises charges and other operating costs are a separate budget question and can vary locally. Do not confuse allocation of national tax revenue to local government with a city-imposed salary tax rate.
Company structure also matters. A local branch, subsidiary, foreign employer and independent contractor arrangement can have different registrations, tax exposures and employment responsibilities. Before hiring, identify the legal employer, who pays and bears the cost, who directs the work and whether the operation creates a permanent establishment or shifts management of an existing foreign company.
Build an employer calendar before the first pay run
The operational file should cover employment terms, work permission where required, contribution registrations, payroll declarations, wage and leave records, workplace obligations and the annual employee-tax information process. Current filing dates and contribution categories should be confirmed for the actual payer; a director, sole shareholder or civil-contract worker may not fit the ordinary employee table.
We can coordinate the business and cross-border analysis with the local payroll and employment professionals appointed for implementation. A useful deliverable is a documented employer-cost model and compliance owner for each obligation. This page supplies the researched 2026 framework; it does not claim to calculate every person’s net salary or every employer’s complete burden.
