From preparation to completion

A tax departure needs event-specific deadlines. These stages do not imply an authority approval is required for every residence change.

Departure is a change of facts

A flight and a new address do not by themselves end Polish tax residence. Examine the centre of personal/economic interests, time in Poland and the other country’s law. If both countries claim you, apply the treaty. A retained spouse, available home or actively managed business can carry more weight than a declaration written after the event.

Create a dated departure file: when each household member moved, when the new home became usable, when employment changed, and where corporate decisions were taken. Include the facts that work against the preferred conclusion as well as those that support it. This makes the analysis reviewable and helps the receiving-country adviser understand the Polish starting position.

Test the individual exit charge before selling or moving

PIT exit tax concerns a loss of Polish taxing rights over specified assets, not a general tax on a suitcase crossing the border. Covered private assets include company interests, shares, securities, derivatives and fund interests, with the five-out-of-ten-year residence condition. The PLN 4 million test concerns the aggregate market value of covered transferred assets; it is not the amount of tax-free appreciation.

Prepare both market value and tax basis at the relevant date. A founder with illiquid shares may have a substantial potential liability but no sale proceeds. The 19% or 3% statutory branch, treaty effect and any relief/payment arrangement need to be resolved before the move. Private property and business assets must not be mechanically placed in the same exit-tax category.

Payment relief is not a filing holiday

The enacted 2025 amendment extends specified personal exit-tax payment dates into 2027. Read it together with the base regulation: a disposal or other relevant loss event can accelerate payment, while the remaining covered cases use 31 December 2027. This is an extension in a defined scope, not an assurance that every taxpayer can wait until that date.

Declaration timing and payment timing must be scheduled separately. Keep the original valuation, the triggering date, future disposals and any requested instalment/relief correspondence in the same file. A later change in law or court decision should be assessed against the existing liability rather than assumed to cancel it. Corporate exit tax uses a separate regime.

Under the amended regulation, covered monthly declarations run from 1 January 2019 through 30 November 2027. A disposal, exercise of a derivative right or another event losing all or part of the asset before 1 December 2027 triggers payment by the seventh day of the following month; the remaining covered cases use 31 December 2027. The underlying PIT Act art. 30da(14) declaration deadline must be considered separately. The ordinary declaration is due by the seventh day of the month after the month in which the aggregate market value of covered transferred assets exceeds PLN 4 million; subsequent covered transfers also have a next-month seventh-day declaration. The payment extension is a separate rule.

Companies, contracts and people may remain taxable

Leaving personally does not migrate a Polish company. Conversely, moving management or business assets abroad can raise company exit tax, permanent-establishment and transfer-pricing questions. Record who now has authority, where staff perform functions and which entity owns or uses the transferred assets. Terminating a local payroll contract does not automatically terminate all employer obligations.

Where a Polish property, operating business or source of income remains, continuing returns or withholding can remain necessary after nonresidence. Review dividends, directors’ fees, rent, sale proceeds and deferred remuneration by source and treaty article. Update banks and payers with accurate residence information without suggesting that a foreign certificate exempts all Polish income.

Coordinate the receiving country’s opening position

Before relying on a departure valuation, ask the receiving adviser what basis it will actually accept for each asset and why. An EU business transfer rule is different from an individual arriving with ordinary investments. The two countries can use different dates, exchange rates and ownership classifications.

A written reconciliation should list the Polish exit value, original cost, receiving-country basis and the mechanism for any future credit or adjustment. Where a private asset’s arrival treatment remains unresolved, mark it as unresolved and obtain the ruling or advice needed before an irreversible transaction. An apparent low future rate can be misleading if it applies to a much larger gain.

An orderly administrative exit

Preserve electronic access to tax filings and arrange a reliable correspondence address. Review address records, insurer/employer notifications, property obligations and the consequences of absence for each family member’s permit or future citizenship application. A tax move and an immigration absence are governed by different tests.

The departure plan should end with a responsibility list: who files the final resident-period return, who reports ongoing Polish income, who monitors an exit-tax payment event, and who retains company books. Our review can coordinate those questions with the destination plan and the appointed local advisers.
