Eligibility & suitability

Who can qualify

  • Foreign applicants with qualifying own foreign-source funds, documented ownership and an eligible maintained investment

Restrictions & unsuitable cases

  • Investments below the category’s net-value threshold
  • Third-party gifts used as the required investment
  • Applicants requiring immediate citizenship or unrestricted liquidity

Application process & timeline

The current decree separates investment certification from immigration resolution. Its official working-day limits begin with the specified complete-file admission or receipt, not with an initial inquiry or property reservation.

01Confirm applicant, family and investment categoryBefore paying a reservation or committing capital+

Check admissibility, beneficial ownership, own-funds requirements and the exact property, securities or deposit category. Review any pre-existing investment or binding contract separately under the transition provisions.

Documents & evidence

  • Passport and family records
  • Ownership chart
  • Proposed investment terms
Common complications
  • Applying the B/.300,000 threshold to resale property
  • Relying on a gift as qualifying own funds
References [4]
02Complete the investment and trace the fundsTransaction and document preparation vary+

Keep the international transfer trail and obtain route-specific certificates. Property needs title/cadastral evidence and potentially an independent valuation; securities need licensed-house and instrument records; deposits need bank confirmation of term, ownership and no encumbrance.

Documents & evidence

  • Bank transfer evidence
  • Property/ANATI or securities certificates
  • Deposit certificate where applicable
Common complications
  • Financing that reduces property net value below the minimum
  • Missing foreign-source trail

03Apply for MICI investment certificationOfficial maximum 15 working days after admission of a complete file+

MICI checks and admits the file. If incomplete, its notice permits fifteen working days to correct it; the certification clock does not begin until complete correction is received. Failure to correct can require a new application.

Documents & evidence

  • Application and power of attorney
  • Investment evidence
  • Source and beneficial-owner documents
Common complications
  • Counting the clock from an incomplete upload
References [4]
04Submit the complete immigration applicationCertificate valid for three months at complete-file submission+

Use the valid investment certificate, general immigration and family evidence, and the prescribed government payments. The immigration resolution has an official maximum of thirty working days from formal receipt of the complete file, subject to lawful suspensions. Later certificate expiry caused by authority delay does not itself require renewal if the complete application was submitted while the certificate was valid; expiry before filing or applicant-caused delay is treated differently.

Documents & evidence

  • MICI certificate
  • General immigration documents
  • Government-payment receipts
Common complications
  • Letting the certificate expire before filing
  • Mistaking a statutory limit for guaranteed end-to-end completion

05Complete biometrics and obtain immigration documentsAfter required local formalities; appointment timing varies+

The application can start through an authorised representative before arrival. Before obtaining any immigration card, the applicant and relevant dependants must complete biometric affiliation and immigration registration. Verify the grant and each family member’s documents.

Documents & evidence

  • Approval resolution
  • Passports
  • Biometric/registration evidence
Common complications
  • Assuming remote filing removes every in-person requirement
References [4]
06Maintain and document the investmentFive years; annual evidence in 30 days before each resolution anniversary+

Calendar investment verification, permit-related visits and any family changes. Notify material investment cessation or modification and follow the applicable reinvestment rules before funds are withdrawn or property is sold.

Documents & evidence

  • Annual investment certification
  • Visit records
  • Updated family or investment documents
Common complications
  • Selling first and checking immigration consequences afterward

Current qualifying investments under Decree 17

Decree 17, published in the official gazette on 16 September 2026, replaces the earlier Qualified Investor framework. It allows a qualifying investment using the applicant’s own, traceable foreign-source funds. Third-party gifts and other gratuitous transfers do not count toward the required minimum. Investment through a legal entity is possible where beneficial ownership and effective control are properly established. Pre-existing applications and commitments have transition protections, explained below.

Choose the investment category before signing. A new, unoccupied property transferred by the developer is treated differently from property previously marketed, occupied or rented. The computable property value is the lower of the amount actually paid and supported commercial value, less relevant secured encumbrances.

Where a property or other investment has several unrelated principal applicants, each principal must demonstrate the required minimum. A principal and included spouse or dependants may count a jointly held family investment once, provided ownership and the full net qualifying value are established. Joint ownership therefore does not automatically divide the minimum among several separate residence applications.

Which rules apply to an existing investment or application?

The decree takes effect on promulgation and replaces Decree 722 and its 2022 and 2024 amendments. Articles 18 and 19 preserve specified earlier positions. Keep the filing acknowledgement, binding contract, payment evidence and existing MICI certificate: the date and legal character of the commitment can determine which rules apply. A current marketing page showing only the new threshold is not enough to decide an older case.

Your position at entry into forceApplicable protection or routeWhat must be established
Application already filed with MICI or MigrationRequirements, conditions and investment amounts applicable when filed continue; more favourable procedural rules can apply immediately.Document the actual filing date and the category accepted.
Investment completed or binding contract perfected before entry into forceThe previous regime may be used if the corresponding application is filed within six months after entry into force.A qualifying prior legal commitment and timely filing; an informal inquiry is not a binding contract.
MICI investment certificate already issuedThe certificate retains effect until its expiry. New valuation rules do not retroactively invalidate a previously certified investment merely because the method changed.Retain the certificate and its expiry date. Objective indications of falsity, sham arrangements, fraud or illicit funds permit a due-process review.
Existing or pending residence under own economic solvencyArticle 18 permits an application to change to Qualified Investor within twelve months after entry into force, with the applicable investment amounts and other requirements met.For this conversion, investments before 15 October 2020 are excluded. Later investments still require traceable funds, ownership and qualifying value.

Government payments are additional to the investment

Article 11 requires the principal to pay B/.5,000 to the Treasury for the application and B/.5,000 to Migration as a repatriation deposit. Each included dependant requires B/.1,000 for each of those categories. Professional fees, certification, translation, banking, property taxes and transaction costs are separate.

For example, a principal with three dependants using qualifying B/.300,000 first-sale property faces B/.16,000 in these specified government payments in addition to the capital, before other costs. This is a component illustration, not an all-in quote or an assurance that a particular property qualifies.

Preconstruction and securities require additional diligence

A purchase promise can qualify through a compliant fiduciary deposit or full payment to the developer. The latter requires an irrevocable, unconditional bank instrument payable on first demand, maintained until construction, segregation and registration. Annual evidence is required, and residence based only on purchase promises cannot extend beyond the decree’s three-year cumulative limit.

If completion and registration fail for reasons attributable to the developer, Article 7 provides a special replacement period of 180 working days after the contractual deadline. A second purchase promise can be used only once; if that also fails, the substitute must be a completed direct investment. The separate three-year cumulative limit still matters. These conditions should be addressed in transaction due diligence before funds are committed.

The securities option covers permitted Panama-impact investments through licensed institutions, rather than any global brokerage portfolio. Market falls and voluntary withdrawals have different treatment. The decree provides a ninety-calendar-day restoration period after notice for qualifying market fluctuations; a withdrawal should not be assumed to have the same protection.

Maintenance, family changes and naturalisation

The investment must remain qualifying for at least five years. Annual evidence is submitted through the legal representative within the thirty calendar days before the residence-resolution anniversary. A cessation or change must be reported within thirty calendar days; the ordinary reinvestment mechanism is up to ninety calendar days, with special rules for developer default.

Article 17 permits a new civil spouse married after the principal’s approval and children subsequently born or adopted to be included directly as permanent-resident dependants, while the qualifying investment continues. Each requires authenticated civil records, current investment certification, a notarised support undertaking and the prescribed government payments. This specific provision does not establish an unrestricted right to add any extended relative.

Death, divorce, reaching adulthood and other changes to dependency must be notified. Continued, modified or terminated status is determined individually through a reasoned decision and hearing; the decree does not prescribe automatic cancellation without that process.

Article 14 permits an application for naturalisation after five consecutive years of residence, subject to the Constitution and all other requirements. Holding an investment or a residence card for five years does not by itself prove eligibility. MICI’s programme page describes a visit at least every two years to maintain residence; that limited visit pattern should not be equated with naturalisation residence.

Who should compare a different route

The route is unsuitable if the money must remain freely available, the investment depends on a third-party gift excluded by the decree, or the applicant expects immediate citizenship. A qualifying lifetime pension may make Pensionado more appropriate; an eligible nationality and qualifying economic basis may make Friendly Nations worth comparing.

Neither permanent residence nor an investment certificate establishes that the applicant has ended tax residence abroad. A business owner should map personal work, company management and income source before relying on Panama’s tax framework.
