What the tax system covers

Panama principally taxes Panama-source income. Where the work, capital or business activity generating the income is located matters more than the customer's address or payment currency. Immigration status is not itself a tax-residence or income-exemption ruling.

When you become tax resident

DGI describes a physical-presence criterion exceeding 183 days for individual tax residence, while the full statutory and treaty analysis may involve other facts. A permanent-residence card is immigration evidence; it is not automatically a tax-residence certificate. DGI’s certificate process asks for entry and exit records, a home or lease, utility evidence and the applicant’s local activity. Plan to substantiate the reality of the connection rather than buying a document and hoping it settles the issue.

Rates and the tax base

0%–25% progressive income tax. Taxable income up to B/.11,000 is at 0%; the next band to B/.50,000 is 15%, with 25% above that threshold. This is the taxable-income scale, not a tax on every foreign receipt.

Private investment gains and business trading

Panama has taxable capital-gain categories, including covered securities disposals. A buyer’s 5% gross withholding is an advance mechanism rather than a universal final gains rate. Territorial sourcing, the underlying entity or asset, and statutory exemptions determine exposure; property and business disposals require separate calculations.

Asset cost basis on arrival

The arrival cost-basis treatment for this country has not yet been established in this comparison. Do not assume either an arrival-value reset or retention of original cost.

  • The treatment needs to be checked separately for ordinary shares, funds, property, business interests and assets acquired by gift or inheritance.

Classify each income stream

Panama’s tax framework is principally territorial. The practical question is whether income is Panama-source under the relevant rule. Foreign customers, foreign invoices or an overseas payment processor do not automatically answer that question.

Separate services performed in Panama, business activity abroad, dividends, interest, property and disposals. Ask who earns the income and where the functions producing it occur. Treat an active online business differently from a portfolio that requires no local work.

The ordinary rate calculation

The published individual schedule is zero through B/.11,000, 15% on taxable income between B/.11,000 and B/.50,000, then B/.5,850 plus 25% above B/.50,000. The general company rate is 25%. A calculation still needs the correct source, taxpayer, deductions and any specific regime before those percentages can be applied.

DGI’s filing guidance distinguishes individual and corporate returns and calendar-year deadlines. Certain taxpayers and income patterns have specific exceptions, so registration and annual-return duties should be checked rather than inferred from an account balance or a residence card.

Define what is actually ending

You may be moving your primary home while retaining Panamanian residence, disposing of a local investment, closing a business or shifting company management. These events have different consequences. Make a separate decision about each rather than treating an airline departure as the whole transition.

A residence permit retained as an option may have visit or maintenance requirements. MICI’s Qualified Investor guidance, for example, describes ongoing investment evidence and visits; confirm the rules applying to your particular category and grant date.

Review the tax position on both sides

A departure review should identify the date personal tax residence changes, the treatment of any sale or transfer, and continuing local income. This draft does not certify that every individual or company can leave without a departure-related charge.

The destination may tax worldwide income, classify a Panamanian company differently or bring it into residence through the owner’s management. Complete that analysis before the move creates a new tax connection.

Reconcile the closing year with continuing local income

Before leaving, list Panama-source business income, rent, investment transactions and any outstanding returns. A move abroad is not the same as a liquidation or sale. Determine which obligations end and which continue under the actual transaction and income-source rules.

Calendar-year filing guidance generally distinguishes 15 March for individual returns from 31 March for companies. A preparer should confirm the filing position and any exception for the specific taxpayer. Keep access to electronic tax records, notices and a local contact after the move.

Tax-residence evidence should follow actual life and operations

DGI’s certificate process looks for substantive evidence: travel movements, a dwelling, utilities and local activities for individuals; operating resources and decision-making for companies. An immigration approval is useful evidence of legal permission but is not a substitute for the tax test.

Where the prior country disputes departure, the complete story matters: where the family lives, which home remains available and where management occurs. A Panama certificate cannot, by itself, override another country’s domestic residence rules or a treaty tie-breaker. Coordinate the departure and arrival files together.

Foreign companies and income attribution

A general CFC conclusion remains under review. Separately, Decree 32 implements scoped foreign-passive-income and substance rules for Panama entities in multinational groups from fiscal years beginning in 2027; this is not blanket personal worldwide taxation.

Departure, migration and continuing obligations

A current comprehensive personal and corporate departure analysis is required; this draft does not certify an absence of exit charges.
