Eligibility & suitability

Who can qualify

  • Individuals who establish Cyprus tax residence and qualify as non-domiciled under the relevant legal tests.
  • Eligible people reaching deemed domicile who separately satisfy and elect the statutory extension.

Restrictions & unsuitable cases

  • Applicants relying only on a residence permit, purchased apartment or nominal company role.
  • People treating non-dom as an exemption for employment, business profits or all health contributions.

Application process & timeline

The sequence below separates application preparation, official decision stages and continuing obligations. A statutory deadline or published target is not an estimate of end-to-end delivery.

01Review the departure-country and treaty positionBefore choosing travel dates or contracts.+

Identify continuing homes, family, business and residence rules in every relevant country. Separate citizenship from domicile and immigration permission from tax residence.

Documents & evidence

  • Residence history
  • Family/home map
  • Treaty analysis
Common complications
  • Assuming a future Cyprus certificate automatically ends residence elsewhere
References [1]
02Select and implement a Cyprus residence testDuring the relevant tax year.+

Plan either the more-than-183-day route or all current 60-day conditions. Put genuine housing and qualifying activity in place rather than preparing documents after the year closes.

Documents & evidence

  • Travel plan
  • Lease or deed
  • Employment/business/office documents
Common complications
  • Only satisfying the day count
References [1]
03Prepare domicile evidenceBefore claiming the SDC exemption.+

Reconstruct domicile of origin, any domicile of choice and the 20-year residence history. Use the department’s questionnaires and explain any Cyprus connections.

Documents & evidence

  • Family history
  • Prior residence records
  • Domicile questionnaires
Common complications
  • Confusing place of birth with a complete domicile analysis
References [1]
04Submit registrations and non-dom declarationAdministrative processing variable; no verified universal service time.+

Complete tax registration and the current non-dom declaration route, retaining acknowledgements. Resolve any conflict between older form text and the applicable amended law before signing.

Documents & evidence

  • T.F.38 and relevant questionnaires
  • Identity and address evidence
Common complications
  • Signing an outdated factual declaration without reviewing its wording
References [1]
05File and confirm the actual annual positionAt annual reporting and before a certificate request.+

Reconcile days and activity with supporting evidence. Classify salary, business income, dividends, interest and rent, and calculate any taxes or contributions outside SDC relief.

Documents & evidence

  • Returns
  • Presence record
  • Income classification
  • Tax-residence certificate file
Common complications
  • Treating a prior-year certificate as current proof
References [1][3]
06Monitor deemed domicile and any extensionAnnually; review well before the 17-of-20 threshold.+

Update the history and compare the optional extension cost with expected SDC exposure. The extension has its own conditions, application and payment; departure does not simply erase the recorded residence history.

Documents & evidence

  • 20-year schedule
  • TD631 where applicable
  • Payment and election records
Common complications
  • Assuming the non-dom period resets after a short absence

Define which charge is relieved

Non-dom treatment is relevant to Special Defence Contribution. It must not be described as a general exemption from personal income tax, health-system contributions or tax on work. Dividend, interest, salary, trading and property receipts require separate classification.

A business owner should model the path from corporate profit to personal income. Foreign-company residence, local operations, transfer pricing and taxes in the country where revenue is earned remain relevant. The fact that a distribution may receive favourable personal treatment does not validate how the company earned it.

Build an evidence file that survives questions

Prepare a residence history, travel calendar, housing documents and evidence of the qualifying Cyprus activity. For domicile, collect the relevant family and legal history and prior residence records. Use the Tax Department’s current forms and registration process, and retain certificates and correspondence.

Where two countries could claim residence, review the treaty and the facts instead of assuming the Cyprus certificate automatically defeats the other claim. The departure plan should be ready before the arrival plan is implemented. This is especially important when a family home or meaningful management activity remains abroad.

Maintenance and decision points

Review residence each year, including any change or termination of the activity supporting the 60-day route. Track the accumulated residence history relevant to deemed domicile and confirm any current statutory alternatives before relying on them. The programme cost is not simply rent and a flight: include real operations, accounting, filings, insurance and administrative support.

We can assess whether the arrangement suits the individual and coordinate the company, banking and residence work. The useful outcome is a documented position based on actual conduct, with a clear calendar of what must be maintained.

The current 60-day test and obsolete forms

The current Tax Department page lists four cumulative conditions: at least 60 days in Cyprus, no more than 183 days in another single country, a qualifying business/employment/office-holder connection in Cyprus, and a permanent home owned or rented there. It warns that termination of the relevant activity during the year can defeat residence for that year. Arrival counts as a Cyprus day; departure counts as a day outside, with specific same-day rules.

Older official forms still state that the person must not be tax resident elsewhere. The current 2026 guidance omits that additional condition. Do not silently combine the old form with the amended test. Equally, the amendment does not make another country’s residence claim disappear: dual residence, treaty entitlement and the actual centre of life still need analysis. A Cyprus certificate cannot dictate how the departure country applies its own law.

Non-dom extension and the 2026 rental change

The deemed-domicile test applies after Cyprus tax residence in at least 17 of the preceding 20 years. Current guidance provides an alternative for eligible people without a Cyprus domicile of origin: up to two additional five-year periods, with €250,000 paid for each period. Use the 2026 TD631 procedure and its conditions; this is a substantial optional payment, not an automatic free extension.

The department also states that rental income ceased to be subject to Special Defence Contribution after the 2025 tax year. This change is separate from income tax on rent. Similarly, relief from SDC on dividends and interest is not relief from every health contribution, foreign withholding tax or corporate tax. Classify each receipt first and apply the relevant charge separately.

Practical example: a mobile business owner

Consider an owner who spends 70 days in Cyprus, keeps a long-term home there and holds an active Cyprus company role, but whose spouse and children remain in the previous country. The Cyprus conditions must be tested on their facts; the former country may still assert residence through family or home connections. If the owner directs the Cyprus business primarily from that other country, a second company-level issue also arises.

The implementation task is therefore more than obtaining a lease, directorship and certificate. It requires a workable schedule, genuine activity, documented decisions and a departure-country analysis. If those facts cannot be sustained, an ordinary longer stay or a different destination may be a more reliable choice. Review the annual facts before issuing tax-residence statements to banks.
