Retest both residence routes in the departure year

A departure does not automatically make the whole year nonresident. Recalculate Cyprus presence under its arrival and departure counting rules and determine whether the more-than-183-day test is met. If not, review all conditions of the 60-day test, including the permanent home and relevant Cyprus activity or office. A director who keeps the office and home after moving may need a different analysis from someone ending every connection.

Establish the destination’s residence start date and whether there is an overlap. Apply the treaty to the actual facts where both countries claim residence. Preserve travel, accommodation, employment or business changes and the new foreign tax certificate. Do not issue inconsistent residence declarations to different banks merely because different answers appear convenient for account opening.

Non-dom history continues to matter

The deemed-domicile calculation uses a historical residence period, not just the current year. Current guidance says a person deemed domiciled after the relevant seventeen-out-of-twenty-year test retains that status until the statutory twenty-year nonresidence condition is fulfilled. A short departure should not be assumed to reset the clock. The paid extension has its own eligibility and payment conditions.

Review the treatment of dividends, interest and other receipts in the last resident year and in the new country. Distinguish the date income legally arises from the date it reaches a bank account. A former resident can also retain Cyprus-source obligations; the Tax Department notes, for example, that directors’ fees paid by a Cyprus-resident company can remain taxable subject to treaty provisions. Residence and source must therefore be examined separately.

A shareholder move does not automatically move a company

A Cyprus-incorporated company remains subject to the current incorporation-based residence rule unless treaty treatment changes the result. Moving the director abroad may also cause the other country to claim residence or a permanent establishment. It does not provide a simple choice of whichever corporate tax system is cheaper. Resolve the dual-residence and management facts before continuing business from the new home.

Prepare a board and operational transition: authority, banking mandates, senior decision-makers, staff, assets, contracts and information access. Review corporate exit or transfer consequences under the applicable legislation where functions, assets or residence move. This guide does not label Cyprus as having a general personal exit tax on all private assets; corporate migration and private emigration are different events and require different calculations.

Close personal obligations and preserve lawful status

Update tax and banking contact details and determine whether any Cyprus returns, source-income declarations or payments remain due. Keep copies of the residence and domicile evidence, filed returns, investment records and tax payments for use in the destination. The 2026 expansion of filing obligations makes assumptions based solely on the former income threshold particularly unsafe.

If retaining an investor residence permission, review its absence and maintenance conditions before a long move away. If pursuing naturalisation, a departure can interrupt the final continuous year or reduce qualifying earlier residence even while a permit remains valid. Treat the immigration decision, the tax decision and the company decision as separate entries in the departure plan, each with an accountable professional and the applicable deadline.
