Start with each country’s own test
Tax residence describes a connection that a country uses to determine the scope of an individual’s taxation. The rules can look at days, homes, family, work, ordinary residence or other ties. A familiar 183-day number is only useful after identifying the exact rule, period and counting method.
The UK Statutory Residence Test uses automatic tests and, where needed, sufficient ties. Canada’s official guidance places substantial weight on residential ties and the whole factual position. These examples show why a travel calendar alone may not establish that someone has left one country or become resident in another.
How the analysis fits together
Tax residence is a year-by-year legal conclusion built from dated facts. Record when homes become available or cease to be available, when family members move, where work is performed and how days are counted. A country using a calendar year may overlap differently with one using another tax year. A certificate for one period does not settle every other period or another authority’s application of its own rules.
When two domestic systems treat a person as resident, a relevant tax treaty may resolve residence for treaty purposes. That analysis follows the treaty actually in force and can require a sequence of tests rather than a choice made by the taxpayer. It does not necessarily erase all domestic reporting obligations. Where no treaty applies, the plan must account for the possibility that both systems retain a claim.
Assessment sequence
This is a review framework. The applicable domestic provisions and any relevant treaty determine the result in a particular case.
| Step | What to establish |
|---|---|
| Domestic tests | Apply each relevant country’s residence legislation to the relevant tax year before considering relief. |
| Evidence and dates | Reconcile travel, housing, family, work and significant changes; record uncertainty rather than choosing a convenient date. |
| Dual residence | Check whether a treaty applies, which person and taxes it covers, and what its residence article requires. |
| Income scope | Identify the income taxable as a resident and the local-source income taxable after non-residence. |
| Implementation | Align registrations, tax returns, bank self-certifications and the household’s actual conduct with the supported conclusion. |
Keep immigration and tax evidence separate
A visa answers an immigration question. Citizenship answers a nationality question. The OECD’s tax-residence portal expressly cautions that a right to reside or citizenship does not automatically establish new tax residence or extinguish the old one. A residence certificate is useful evidence, but its implications still depend on the relevant law and treaty.
For a family, the dates can differ. One spouse may move before the other; children may finish a school year; the founder may continue working from the previous home. Record those facts accurately rather than forcing everyone onto a single preferred date.
Deal with overlap before it becomes a dispute
Two countries can initially regard someone as resident under their domestic laws. The applicable treaty may provide a way to resolve residence for treaty purposes, but the precise article, eligibility and effect need review. Domestic filing or disclosure obligations can remain even when treaty relief changes the tax result.
Prepare a timeline of homes available, nights and workdays, family movements, employment, business roles and major transactions. Record the reason for each proposed residence conclusion and identify evidence supporting it. A bank self-certification should be consistent with the resulting analysis, including multiple residences where required.
Make the plan fit an actual life
An arrangement that depends on implausible travel or keeping family life somewhere the individual claims to have left is difficult to maintain. Compare schooling, community, healthcare and work routines alongside taxation. The best destination is one the household can use comfortably while meeting its real obligations.
We can connect the departure and arrival reviews, then translate the conclusions into a calendar of registrations, filings and practical tasks. Revisit the position when a home, job, relationship or travel pattern changes; residence is a continuing factual assessment.
Common misunderstandings
- The widely repeated 183-day figure is not a universal safe harbour.
- A residence permit is evidence of immigration status, not a complete tax analysis.
- Residence certificates and bank declarations should reflect the facts for their particular period.
