Choose permission for the activity you will do

An entrepreneur, employee, investor and accompanying family member may need different admission routes. Before establishing an office or signing employment contracts, identify the current route and its evidence requirements with Immigration. This draft does not present a visitor permission as authority to operate any business or work locally.

Reconcile the business facts

List where supplier relationships are negotiated, contracts concluded, services delivered and company decisions made. Hong Kong sourcing analysis is more detailed than asking where invoices are sent. If another country still contains the owner, staff or inventory, that country’s tax, payroll or permanent-establishment rules can remain relevant.

Build the record from arrival

Preserve employment, housing, family and travel records if ordinary residence or future right of abode is relevant. Banks will separately ask about ownership, expected activity and funds. For a group holding investments, classify foreign receipts before remitting them. A sensible move makes immigration, operations and reporting consistent rather than using one document as proof of everything.

The entrepreneur route tests the business, not only the investment

The Immigration Department considers whether the proposal can make a substantial contribution to Hong Kong. Prepare a three-year business plan, market and sales assumptions, forecast profit-and-loss statements, cash flow and balance sheets. An existing overseas business should supply relevant historic accounts and evidence of the applicant’s experience. Funding must be credible relative to the proposed operation.

An applicant nominates a local sponsor under the published rules. Include company documents, proof of investment, proposed premises and local staffing where relevant. A template plan describing every industry is weaker than a specific explanation of products, customers, suppliers, capital needs and what will actually happen in Hong Kong. Permission remains discretionary even where the stated criteria are met.

Treat the published processing period as one stage

The official entrepreneur page says processing normally takes four weeks after all required documents and the application fee have been received. This does not include preparing the plan, obtaining civil documents or answering later questions. Distinguish the non-refundable application charge from the visa-issuance charge and from capital invested in the business.

After approval, follow the entry and residence instructions and arrange identity and dependent formalities applicable to the grant. Review whether each family member can work under their own conditions. Do not sign an inflexible long-term lease or restructure every customer contract around an assumed approval date. Build a practical transition window in which the existing business can keep operating lawfully.

Build tax and banking evidence as operations begin

Record the date and location of the applicant’s work, business negotiations and strategic decisions. A company that previously operated outside Hong Kong may have a different source analysis once its owner starts performing core activities locally. Review employee payroll and employer reporting before the first payment. Seven-year ordinary residence is a long-term immigration concept, not a tax exemption for the first seven years.

Bank preparation should happen alongside incorporation and immigration, with accurate ownership, business and source-of-funds records. Confirm the actual account-opening channel and attendance requirements for the proposed applicant. Set up bookkeeping and a document repository early, including contracts, invoices, travel records and evidence supporting any foreign-source claim. This makes future tax filings and bank reviews an extension of the operating process rather than an exercise in reconstructing missing history.
