Two statuses that are often confused
Right of abode in Hong Kong is not the same as Chinese nationality. A non-Chinese person may become eligible for permanent-resident status after the required continuous ordinary residence and other conditions, yet still hold only their existing foreign passport. An HKSAR passport requires the relevant Chinese nationality and Hong Kong status conditions.
The seven-year ordinary-residence route
Immigration describes a route for a non-Chinese national who entered with a valid travel document, ordinarily resided continuously for at least seven years and has taken Hong Kong as their permanent place of residence. Ordinary residence is a factual concept; it is not simply keeping a card or reaching a mechanical annual day total. Evidence of work, home, family and absences matters.
Nationality requires a separate review
Naturalisation as a Chinese national is a distinct application under the nationality framework. Assess eligibility, the evidence of connection to Hong Kong and the implications for existing nationality. Do not assume that permanent residence converts automatically into a passport or that the applicant can freely retain all other nationalities.
Maintain evidence and understand travel rights
Preserve residence records and check what extended absence means for a non-Chinese permanent resident’s status. Where the comparison describes visa-free travel on an HKSAR passport, it refers to that passport, not every Hong Kong resident. British National (Overseas) status is also a separate category. Offshore Capitalist can help connect residence, nationality and business questions without conflating these distinct rights.
Naturalisation involves more than seven years on a calendar
The April 2026 Immigration Department guide explains that article 7 permits applications based on close Chinese family connections, settlement or other legitimate reasons. The assessment considers habitual residence, family, livelihood, taxes, conduct, language and an intention to continue living in Hong Kong. The permanent-residence history helps establish facts but is not an automatic nationality grant.
Article 8 states that an approved naturalisation applicant cannot retain foreign nationality. Review the consequences and required renunciation sequence under both legal systems before taking action. An existing Chinese-nationality question through birth or descent needs a different analysis from a foreign adult’s naturalisation application. Do not assume that a relative’s passport, a permanent identity card or a British National (Overseas) document establishes the same legal status.
Prepare the application, interview and separate passport stage
The guide uses form ID874 for adults and ID875 through a parent or guardian for applicants under eighteen. Evidence includes the Hong Kong identity card, passports and residence records, with employer, school or tax documents where relevant and family evidence for a relative supporting the application. Originals should not be posted; they can be checked during the interview. Report material changes while the case is pending.
The current guide states a HK$3,460 application charge, split between an initial HK$1,730 and the balance at certificate issue; the initial payment is non-refundable. Payment does not guarantee approval, and no universal processing deadline is given here. After nationality is established, an HKSAR passport still requires Chinese nationality, Hong Kong right of abode and the valid permanent identity-card conditions. Review those three elements separately before treating a passport comparison as relevant to the applicant.
