Separate entry, work, long-term residence and local status
The BVI does not have one document that solves every immigration question. Permission to enter or remain, permission to work, Residence Status and Belonger status have different legal functions. Buying a home or incorporating a company should not be sold as automatic permission to live or work here.
For a new arrival, establish the actual lawful entry/work or family basis first. The ten-year Residence Status route is a route for qualifying established residents, not a ten-year visa issued to an investor on arrival.
| Route / status | What it addresses | Important limit |
|---|---|---|
| Visit | Admission for the approved visit and purpose | Does not by itself authorise employment. |
| Employment / appropriate business activity | Work permission or exemption plus immigration clearance/entry permission | Company ownership is not a replacement for the person’s permission. |
| Conditional permit | Temporary protection of status following specified changes for an existing permit holder | Not a general application route for someone abroad seeking residency. |
| Residence Status | Current ordinary tenure requirement: ten consecutive years with qualifying absences and other conditions | Certificate is renewed every five years; approval is discretionary. |
| Belonger status | Local status with its own tenure, family and exceptional routes | Distinct from British nationality; see the citizenship guide. |
Employment: from a real offer to lawful entry
The employer should define the role, terms, recruitment evidence and the proposed worker’s qualifications before applying through the Labour Management System. An old downloadable form can help identify supporting evidence, but paper/triplicate instructions should not override the current online process.
The Department’s May 2025 notice requires payment after approval and before Immigration Clearance is issued. Its July 2026 notice requires proper passport photographs and readable scanned PDFs. Work-permit approval, payment, clearance, entry and the appropriate stamp are separate stages; do not schedule work to begin on an assumed approval date.
| Stage | Timing | Evidence / action | Common obstacle |
|---|---|---|---|
| 1. Establish the role | Before application | Employer/trade licence, job description, offer/contract, qualifications and recruitment evidence. | An entity’s name and the employing business should match the application. |
| 2. Submit the online case | No universal end-to-end service time verified | LMS application, passport, photo and required supporting PDFs. | Unclear scans and incomplete documents can be rejected. |
| 3. Approval and payment | After notification, before clearance | Pay as directed and obtain the appropriate clearance. | An approval message is not the final permission to start work. |
| 4. Enter and complete formalities | Follow the approved dates and directions | Travel/admission documents and immigration endorsement. | Check every family member’s status separately. |
| 5. Renew and report changes | Before the existing permission expires | August 2026 renewal checklist includes existing Entry Permit Form, photo, passport bio page and stamp. | A pending application does not automatically repair expired status. |
Residence Status: ten years, then a substantive assessment
The current government service describes ten consecutive years in the territory, no absence exceeding one year at a time, and ordinarily no more than 90 days away in a year. Good character and an intention to make the BVI a permanent home are also required. Special treatment can apply to absence for illness, education or government/military service.
The 2024 enacted amendment and the current service should be used together. Older official FAQs still referring to twenty years for Residence Status should not be substituted for the present application instructions. Cabinet considers the case following the Immigration Board process; reaching a time threshold does not compel approval.
| Evidence group | What the current checklist asks for |
|---|---|
| Identity and civil status | Certified birth certificate, passport bio page and marriage certificate where relevant. |
| Character and health | BVI police and medical certificates within the preceding six months; eligible character references. |
| Connection and capability | History/culture certificate, English proficiency where required, community and qualification evidence. |
| Financial position | Income letter and bank references from all local institutions showing current and three-year average balances and debts; ordinary bank statements are not accepted in place of these references. |
| Business or property interests | Trade/business evidence or non-Belonger landholding/property documentation if applicable. |
| Application and ongoing validity | USD 250 non-refundable application fee; any further grant fee is separate. Residence Certificate renewal every five years. |
Spouses and children need route-specific treatment
A spouse and children under 18 can be endorsed on a Residence Certificate under the current service. A child turning 18 must submit an individual application within six months to remain. That age transition is different from a dependent child’s school admission or a child’s nationality registration.
For endorsement, the checklist includes certified identity documents, a school admission letter and a police certificate for children over ten. A family member’s right to accompany the principal applicant should not be treated as an automatic right to work. Adult children, parents, unmarried partners and same-sex partners require their own eligibility review; this guide does not assume a dependent category exists for them.
| Family member | Published position | Practical consequence |
|---|---|---|
| Spouse | Can be included on Residence Certificate under the published route | Marriage evidence and recognition matter; work rights must be checked separately. |
| Child under 18 | May be endorsed | Identity, school and age-appropriate police evidence are required. |
| Child reaching 18 | Own application within six months | Start preparation before the birthday rather than allowing status to lapse. |
| Same-sex spouse / civil partner | No general BVI recognition established by the reviewed current sources | UK nationality guidance mentioning civil partners is not a BVI immigration recognition rule. |
| Adult child or parent | No general family endorsement assumed | Obtain a separate route decision rather than adding them to a package estimate. |
When employment or family circumstances change
The conditional-permit service is for existing entry-permit holders affected by specified events, including loss of employment and other stated changes. Its checklist asks for evidence of the event and the applicant’s resources and housing. Since January 2026 the application is online.
The published charge is USD 100 for the application and USD 250 for the permit if approved; payment and the appropriate stamp are part of completing the process. Approval of a conditional permit is not a promise that a subsequent work or residence application will succeed. Contact Immigration before the existing basis lapses.
Plan the move around verified approvals
Prepare family certificates, professional documents and a travel/absence history early. Keep original documents accessible after shipping belongings. Budget separately for official fees, professional assistance, translations/certification, medical checks, housing deposits and travel; no single verified government price covers the whole move.
No universal processing time has been verified for these applications. The timeline should therefore have approval gates rather than a promised number of weeks. Once the case is approved, align the household move with employment start, school placement and healthcare enrolment.
