From eligibility review to annual compliance
Application deadlines are prescribed; the authority has not supplied a guaranteed certificate processing time in the material reviewed. The stages below separate that deadline from the practical work before and after arrival.
01Review eligibility before movingBefore commitments
Check the three preceding calendar years and classify historic Turkish activities and filings.
02Coordinate departure and establish Turkish settlementOn the verified residence timeline
Align home, work, immigration permission and departure-country obligations. Record the legally relevant settlement date.
03Apply for the exemption certificateBy year-end; final-two-month arrivals by following February-end
Submit to the competent tax office within the applicable statutory period and retain proof of filing.
04Complete the authority’s checksNo verified guaranteed processing period
Respond to factual questions and retain the issued certificate; application timing and decision time are distinct.

What changed in 2026
Law 7582 inserted repeated article 20/D into Türkiye’s Income Tax Law. The law applies to qualifying individuals treated as settled in Türkiye from 1 January 2026. Final General Communiqué 333 was published on 4 July 2026, and GIB published a dedicated guide announcement on 7 September. This is an enacted exemption with an application process, rather than a proposal or a feature available to every resident.
The ordinary worldwide-tax framework remains the starting point. Eligibility for this particular exemption is a separate question. A passport, property purchase or residence permit alone does not establish entitlement. The benefit also concerns the individual: the tax position of a company they own still needs its own analysis.
First test the three preceding calendar years
The core condition is absence of Turkish domicile and relevant Turkish tax liability during the three calendar years before the person is treated as settled. This is a calendar-year look-back, not simply a count of the last 36 months. The law preserves eligibility where prior Turkish liability arose only from specified rental/property income, investment income or disposal gains. Previous employment or business activity needs particular attention.
For planning, assemble a year-by-year history before selecting a move date. Identify former Turkish addresses, work, businesses and registrations, as well as foreign homes and returns. A tax number is an identifier; the reason for a tax registration and the underlying activity matter. Do not omit an old return because the amount involved was small. A documented exception is stronger than a statement that there has been no connection to Türkiye.
Establish settlement and protect the application deadline
The applicant must already be treated as settled when applying. The communiqué requires an application to the competent tax office for an exemption certificate by the end of the settlement calendar year. Where settlement occurs in the final two months of the year, the application period extends to the end of the following February. The published examples treat a late application as a reason not to issue the certificate.
Determine the relevant settlement date under the residence rules instead of treating the first holiday visit, the property closing or the day a permit card arrives as interchangeable. Turkish domicile and the continuous-stay test can matter differently. Put the filing deadline in the relocation plan before the move and retain evidence of timely submission. The authority’s processing duration is separate from the applicant’s deadline; this research does not establish a guaranteed decision time.
Separate foreign-source income from work performed locally
The exemption concerns qualifying income earned outside Türkiye. Turkish-source income remains within the ordinary rules. The final communiqué specifically illustrates that local professional activity for an overseas customer does not become exempt merely because the customer is foreign. Bank location and invoice currency cannot replace the source analysis.
A useful review starts with each stream: dividends from a foreign company, rent from foreign property, interest, investment disposals, salary, consulting fees and business profits. Record who earns it, the contractual rights, where the work or asset is located, and when the income arises. Then identify the legal source rule for that category. This can produce different answers for two receipts paid into the same account. An owner’s genuine foreign dividend and fees for work they personally perform after moving should not be treated as one category.
A company remains a separate taxpayer
Türkiye’s corporate rules can impose full liability where a company’s legal centre or business centre is in Türkiye. The personal exemption does not turn a foreign-incorporated company into an exempt entity. Corporate residence, a permanent establishment, transfer pricing and withholding therefore require a parallel review.
Before relocation, map the decisions the owner makes and decide how the business will function afterwards. Establish which directors and staff have genuine authority, where contracts are negotiated and approved, and where the commercial activity occurs. If responsibilities change, the change must be real and supported by operations. The goal is a coherent business arrangement, not a file of foreign addresses that contradicts day-to-day conduct.
Prepare an evidence file rather than a promise of eligibility
The tax office checks the residence history, prior tax-liability history, present settlement and application timing before issuing the certificate. GIB’s September guide is the current official starting point for the administrative process. The authority may need information specific to the applicant; a universal published processing timetable has not been verified.
The following is a practical preparation checklist, rather than a claim that each item is a universally mandated attachment. Confirm the local office’s current documentary, translation and representative requirements before submission.
- Identity, relevant Turkish tax identification and current address records.
- A dated settlement explanation, with travel and home evidence supporting the actual residence test.
- A three-calendar-year schedule of previous residences, work and Turkish tax connections.
- Copies of previous Turkish filings and a classification of any rental, investment or disposal income exception relied on.
- An income inventory, contracts and asset records supporting the distinction between foreign and Turkish sources.
- The written application, submission acknowledgment, follow-up correspondence and issued exemption certificate.
Maintain the separation after approval
Covered exempt income is omitted from the annual return, including where a return is filed for other income. Related expenses cannot be used to reduce taxable income, and foreign tax paid on exempt income cannot be credited against unrelated Turkish tax. Tax in the source country does not disappear merely because Türkiye exempts the receipt.
Keep an annual income and activity review. A new customer, a change in duties, an asset sale or relocation of management can alter the source or entity analysis even if the certificate remains on file. If the eligibility conditions were not met, the communiqué provides for recovery of underpaid tax with applicable penalties and interest. Preserve the original factual evidence and update the working file when circumstances change.
Coordinate the move from both countries
The practical comparison is the whole relocation. Establish what the departure country continues to tax, whether residence actually ends, and whether a departure charge or ongoing company attribution applies. Compare the timing of income, disposals and distributions with the Turkish arrival date. A Turkish exemption cannot settle another country’s independent taxing claim.
Immigration permission and the right to work are separate workstreams. Confirm the correct residence category and permissions for the intended activity; do not buy an asset solely because someone combines a citizenship advertisement with a tax headline. We can help assess the international plan, coordinate the appropriate Turkish professionals and implementation, and define the ongoing reviews needed for the structure to continue working.
