Document checklist
Track your preparation in this browser. Final requirements depend on the route and filing authority.
Match the permit to the work you will actually do
This route can cover qualifying independent remunerated activity or service as the chief executive of a business organisation. It is not a residence entitlement arising merely from buying a company. If the executive also performs operational work beyond the executive role, the appropriate employment or other work authorisation must be assessed.
OIF asks for credible business evidence. For an executive, one branch concerns a business employing at least five Hungarian/free-movement workers full-time for at least six consecutive months. Another requires the applicant’s presence to be essential and a substantiated business declaration showing a realistic ability to generate the required income. These are alternative evidential branches, not a universal instruction to hire five people before every application.
Contracts and cash flow should support the business statement
For registered independent activity, the authority lists tax evidence that annual self-employment income exceeds 24 times the current minimum wage and that taxes and contributions are not in arrears. The detailed requirements should be matched to the actual initial or continuing business case; a startup should not assume a projected revenue figure is equivalent to established taxable income.
The executive file should explain customers, contracts, delivery, staffing, management responsibilities and why the applicant is needed in Hungary. Supporting documents can include genuine service, purchase and sales agreements, tax-clearance information and proof that employee registration and tax obligations have been met. A generic plan copied from another industry is unlikely to answer the questions raised by a real business.
Plan for the first-year family restriction and ongoing duties
Initial validity is up to one year; extension for the same purpose can reach the statutory three-year total from first issue. Reissue and later applications have their own conditions. Holders are subject to regular reporting through the authority’s specified channels; completing the first application is not the end of the immigration work.
Family reunification is generally restricted for one year from issue, with the specific exception for permits reissued after three years and the narrow child-born-in-Hungary provision. The national residence card is excluded for this category, and in-country switching to another purpose is restricted. Check the complete family and long-term plan before making the business investment.
| Workstream | Evidence to maintain |
|---|---|
| Business activity | Contracts, invoices and records consistent with the approved activity |
| Executive role | Real authority, essential-presence explanation and actual duties |
| Tax and payroll | Timely registration, filings, payments and no-arrears evidence where required |
| Residence reporting | Submitted declarations and confirmation of required updates |
| Renewal and family | Validity dates, presence records and each relative’s eligibility |
The permit and the company forecast must agree
A Hungarian operating company requires its own corporate, local business tax, VAT, payroll and banking analysis. The 9% CIT rate does not resolve owner remuneration or the tax on profit extraction. If the applicant already controls overseas entities, moving decision-making to Hungary also needs a management and CFC review.
We can help assess the structure and coordinate the agreed formation, banking and residence implementation. The business must remain commercially real and the owner’s responsibilities accurately described. Professional fees and actual business capital or operating costs are separate; no minimum all-in setup price is invented here.
