The process, step by step
Departure timing follows the actual facts and statutory events. No universal tax-clearance or automatic nonresidence promise is made.
01Map the departure factsBefore committing to a tax-residence date
02Separate personal assets from the companyBefore sales, dividends or restructuring
03Implement the operating changesBefore management and contracts actually move
04Notify and preserve accessAround the actual departure and required notice dates
05Reconcile the final and continuing yearAt each applicable filing deadline
A move abroad is a fact pattern, not one form
Establish the departure date and what changes in practice: homes, family, employment, travel and business decisions. The Hungarian personal-residence tests are not reduced to days alone. Hungarian citizenship can itself be a domestic gateway, with a specific dual-national exception; a treaty may then determine residence between two countries. Keep the destination’s residence evidence and explain any Hungarian home or work retained.
A permit cancellation, address update or foreign lease answers only part of the question. Hungarian-source rent, work performed in Hungary, property disposals or other retained connections can remain taxable after treaty or domestic residence moves abroad. Tell payers and financial institutions about the new circumstances using the required evidence rather than merely changing a correspondence address.
What happens to the company when its owner leaves?
Decide whether the Hungarian business continues with local decision-makers, changes management location or transfers functions and assets. A foreign move by the owner does not automatically migrate the company, but the destination may claim corporate residence or a permanent establishment if management follows. Contractual authority and actual conduct should tell the same story.
Hungary has an identified corporate exit regime under section 16/A where it loses taxing rights over specified migrations and transfers. The difference between market value and statutory tax value can enter the corporate base. An asset retained in a Hungarian establishment may be treated differently, and qualifying instalment provisions need individual review. Commission valuations and assess cash flow before executing the transfer.
Review investments without inventing a blanket exit answer
A complete personal exit-tax absence conclusion has not been established here for every asset and business arrangement. The shared field remains unverified. Review private investments, entrepreneurial assets, employee awards, trusts, pensions and any planned disposal separately, including the destination’s arrival-value and foreign-credit treatment.
Keep the original acquisition history even where another country grants a market-value basis on arrival. A Hungarian liability and a foreign cost reset need not cover the same gain or occur at the same time. If a dividend or sale is planned near departure, document entitlement, contract, payment and residence dates rather than choosing the preferred country after the event.
Preserve access while you close or continue obligations
Arrange authorised access to tax correspondence, records and bank statements before cancelling a local phone or address. Prepare the ordinary final-year personal return, and review advances or self-assessed income rather than assuming the annual draft contains foreign activity. A continuing company still has payroll, VAT, local business tax and annual-account obligations even if its owner lives elsewhere.
Residence-status preservation is a separate decision. Long-term cards have absence and withdrawal rules; a White Card or self-employment permit has its own ongoing purpose and renewal conditions. If retaining an immigration status is important, test the proposed travel pattern before relying on the expiry date printed on the card.
Get a coordinated departure review
A useful review ends with a dated action list: what moves, what remains, who manages each entity, which valuations and returns are needed, and what evidence each country should receive. We can assess the cross-border plan and coordinate the agreed implementation, including independent local advisers or management providers where needed.
Start with your proposed destination, timing, entities, major assets and continuing Hungarian connections. That allows us to distinguish a relatively straightforward household move from a business migration requiring valuations, revised contracts and an ongoing compliance arrangement.
