Choose an immigration route that permits the intended work

An immigration permission is required unless nationality or an existing status provides the necessary right. The Innovator Founder route is for a genuinely new, innovative, viable and scalable business endorsed by an approved body. It is not a passive investment residence programme and does not simply admit anyone who owns a successful overseas company. The founder must be able to substantiate the proposed business and meet the other route requirements.

Other applicants may qualify through work, family or protected residence rights. The tax benefit of the FIG regime does not create an immigration entitlement. Before planning a move, specify who will work, what duties they will perform, whether dependants will accompany them and the eventual settlement objective. Then establish an immigration route for each person and a separate tax residence schedule. Do not treat permission to visit as permission to carry on the proposed working life in Britain.

Apply the Statutory Residence Test to the UK tax year

The UK tax year runs from 6 April to 5 April. The Statutory Residence Test first considers automatic overseas tests, then automatic UK tests, and then the sufficient-ties test where neither automatic outcome applies. Spending 183 days in the UK is an automatic UK test, but staying below 183 days does not itself establish non-residence. Work patterns, homes and connections can produce a resident result at substantially fewer days.

Prepare a year-by-year schedule rather than a single travel total. Prior-year residence affects several thresholds; workdays and full-time work have their own technical definitions. The midnight rule also has exceptions and deeming provisions. Split-year treatment is restricted to prescribed cases and does not simply follow the date a visa was issued or a house was purchased. A founder spending time between two homes needs both the domestic analysis and, where relevant, the treaty residence analysis.

The four-year FIG regime is temporary and requires claims

From 6 April 2025, qualifying new residents can claim relief for specified foreign income and gains during their first four resident tax years after at least ten consecutive nonresident years. Earlier arrivals may use only the remainder of their original four-year window. The clock does not restart because the legislation changed, and unused years are not an indefinite tax allowance.

Classify the receipts before estimating savings. Foreign dividends, investment income, qualifying foreign gains and profits of a trade carried on wholly abroad may be covered; foreign employment earnings use separate rules, including Overseas Workday Relief where applicable. UK work or UK business activity does not become foreign merely because an overseas company pays. Claims through Self Assessment can remove personal and capital-gains allowances and affect other calculations. Model the fifth year before arrival and keep historic remittance-basis funds distinct from new qualifying receipts.

Company residence follows incorporation and actual control

UK incorporation normally creates UK corporate residence, subject to statutory and treaty rules. A foreign-incorporated company can also be resident where its central management and control actually takes place in the UK. HMRC’s case-law guidance examines real strategic control rather than treating the venue written in board minutes as conclusive.

A founder who retains all meaningful decisions while living in Britain needs an analysis of that actual arrangement. Overseas directors must exercise the authority claimed for them; they cannot merely record decisions already made elsewhere. Company residence, a UK permanent establishment, payroll, transfer pricing and anti-avoidance attribution are separate questions. A foreign bank account or local registered office answers none of them by itself. Document the allocation of authority, contracts, financial risk and operational work before the individual move, and assess the relevant treaty if both countries regard the company as resident.

Endorsement comes before the founder visa application

The founder application must include an endorsement issued no more than three months before the application date and not withdrawn. Under the published rules, the endorsing body also examines the applicant’s suitability and the legitimacy of the funding. Prepare a credible operating plan and funding trail before seeking endorsement; purchasing a generic business plan does not establish the founder’s capability.

The sequence is business assessment, endorsement, immigration application, identity/biometric formalities and decision, followed by implementation and ongoing endorsement contact. Budget government application charges, the health surcharge, endorsement and monitoring charges separately. Current official guidance describes required contact meetings during the permission period and possible curtailment if endorsement is withdrawn. The minimum residence period for possible settlement is not a guaranteed approval timeline, and a dependant’s route may have a different settlement clock.

Non-residence depends on the departure-year facts

The departure year must be tested under the Statutory Residence Test. A new overseas home, foreign visa or statement of intention does not substitute for the automatic-overseas and sufficient-ties analysis. Working full-time overseas is a technical test with requirements concerning hours, UK workdays, UK days and breaks; occasional business visits should be recorded accurately.

Split-year treatment is available only where one of the prescribed cases applies. Establish the qualifying circumstances and the date the relevant overseas part starts rather than assuming the flight date splits every category of income. Keep a schedule of homes, family, work and travel, including the years before departure because prior residence affects the thresholds. A return visit or retained accommodation should be evaluated before it happens, especially where the departure plan relies on a relatively narrow day allowance.

Naturalisation ordinarily follows settlement

For the usual adult route, an applicant must have lived in the UK for five years and normally have held indefinite leave to remain or settled status for at least twelve months. A person married to or in a civil partnership with a British citizen uses a different three-year residence framework and does not ordinarily need the additional twelve-month wait after becoming free from immigration time restrictions.

These are eligibility requirements, not a promised decision period. Immigration permission that could eventually lead to settlement does not itself confer nationality. A founder may become eligible for settlement under a particular business route while still needing to meet the separate citizenship residence requirements. Establish the applicant’s status, settlement date and exact filing date before paying the citizenship fee, and assess each family member independently; adults and children do not automatically use identical routes.

Physical presence and absences can determine the filing date

The standard five-year route generally limits absence to 450 days during the qualifying period and 90 days in the final twelve months. The spouse route generally uses 270 days across three years and the same 90-day final-year limit. Discretion exists in defined circumstances, but should not be treated as a guaranteed waiver. The applicant normally must have been physically in the UK on the exact date five or three years before the application is received.

Reconcile passport movements, travel bookings and immigration records before selecting the submission day. A tax-residence conclusion does not prove compliance with nationality residence rules. Conversely, an absence that does not affect a tax year may matter to naturalisation. If relying on discretion, explain the specific circumstances and supply evidence, rather than obscuring the days or describing ordinary commercial travel as an automatic exception.
