Choose an immigration route that permits the intended work

An immigration permission is required unless nationality or an existing status provides the necessary right. The Innovator Founder route is for a genuinely new, innovative, viable and scalable business endorsed by an approved body. It is not a passive investment residence programme and does not simply admit anyone who owns a successful overseas company. The founder must be able to substantiate the proposed business and meet the other route requirements.

Other applicants may qualify through work, family or protected residence rights. The tax benefit of the FIG regime does not create an immigration entitlement. Before planning a move, specify who will work, what duties they will perform, whether dependants will accompany them and the eventual settlement objective. Then establish an immigration route for each person and a separate tax residence schedule. Do not treat permission to visit as permission to carry on the proposed working life in Britain.

Endorsement comes before the founder visa application

The founder application must include an endorsement issued no more than three months before the application date and not withdrawn. Under the published rules, the endorsing body also examines the applicant’s suitability and the legitimacy of the funding. Prepare a credible operating plan and funding trail before seeking endorsement; purchasing a generic business plan does not establish the founder’s capability.

The sequence is business assessment, endorsement, immigration application, identity/biometric formalities and decision, followed by implementation and ongoing endorsement contact. Budget government application charges, the health surcharge, endorsement and monitoring charges separately. Current official guidance describes required contact meetings during the permission period and possible curtailment if endorsement is withdrawn. The minimum residence period for possible settlement is not a guaranteed approval timeline, and a dependant’s route may have a different settlement clock.

Apply the Statutory Residence Test to the UK tax year

The UK tax year runs from 6 April to 5 April. The Statutory Residence Test first considers automatic overseas tests, then automatic UK tests, and then the sufficient-ties test where neither automatic outcome applies. Spending 183 days in the UK is an automatic UK test, but staying below 183 days does not itself establish non-residence. Work patterns, homes and connections can produce a resident result at substantially fewer days.

Prepare a year-by-year schedule rather than a single travel total. Prior-year residence affects several thresholds; workdays and full-time work have their own technical definitions. The midnight rule also has exceptions and deeming provisions. Split-year treatment is restricted to prescribed cases and does not simply follow the date a visa was issued or a house was purchased. A founder spending time between two homes needs both the domestic analysis and, where relevant, the treaty residence analysis.

Prepare the tax and company position before arrival

Collect the previous ten tax years of residence evidence if the FIG regime is relevant. Identify the first UK resident year under the SRT rather than simply counting years from the flight date. For each asset, record ownership, acquisition date, base cost, expected income and planned sale date. Historic remittance-basis funds, if any, need their own analysis.

For a business owner, the parallel file should identify who makes strategic decisions, who performs customer work, where contracts are negotiated and what duties continue after the move. A personal FIG claim cannot protect a company whose management has migrated to the UK. Establish employer consent, payroll and social-insurance treatment for remote work. If a significant dividend or sale is expected, compare source-country tax, UK treatment and the fifth-year position before deciding its timing.

Maintain separate immigration and tax calendars

After approval, keep digital immigration status and identity details accurate, comply with the route’s work conditions and schedule extension or settlement preparation. Residence for immigration purposes and residence under the SRT are measured differently. Travel acceptable under a visa may still affect naturalisation eligibility, and a tax nonresident year does not necessarily preserve an immigration residence period.

Maintain one reconciled travel log supporting both reviews while recording the different legal tests. Prepare Self Assessment and any FIG claim with the relevant filing deadlines, and reassess foreign-company management as responsibilities evolve. Before extending the stay, calculate the ordinary-tax outcome after the four-year window and the longer inheritance-tax residence trajectory. The practical goal is an operating arrangement that remains workable after the initial move, not only a favourable calculation for the arrival year.
