D7, remote work and ARI solve different immigration problems

D7 is generally used by pensioners and people supported by their own recurring income. The remote-work residence route is directed at employment or services supplied remotely to persons or entities outside Portugal. Its income test refers to average earnings over the preceding three months at four times the applicable monthly minimum wage; verify the current reference wage and the consulate’s evidence requirements rather than relying on a dated euro figure.

ARI investment residence uses specified qualifying investments and a different presence framework. Property purchase and a general capital transfer are no longer open qualifying categories for new applications. An eligible fund route generally involves €500,000, a qualifying non-real-estate vehicle, the required maturity and Portuguese-company allocation. EU citizens follow free-movement registration instead of these visa applications. Start with the person’s work, income, nationality and desired living pattern, then choose the route.

Tax residence can begin through days or a habitual home

Article 16 uses more than 183 days in a twelve-month period beginning or ending in the relevant tax year, or accommodation in circumstances indicating an intention to maintain and occupy it as a habitual home. The latter can apply without reaching the day threshold. For the presence calculation, a day includes an overnight stay. Residence is assessed for each household member, rather than automatically following the nationality or status of the principal applicant.

Partial-year rules generally connect residence to the first qualifying day of stay, with exceptions including prior-year residence. The departure rules also contain anti-fragmentation provisions. Before choosing a move date, review the whole sequence across adjacent tax years. A NIF or residence card is an administrative identifier or immigration document, not a substitute for Article 16. If two states claim residence, the treaty and the underlying home and family facts need separate assessment.

IFICI is a targeted work incentive, not a universal NHR replacement

The former non-habitual-resident regime is closed to ordinary new entrants, subject to protected existing and transitional cases. IFICI instead requires a qualifying activity and, where relevant, an eligible employer or business category. It generally requires five preceding nonresident years and is incompatible with specified prior or competing regimes. Passive ownership of a company alone does not establish a qualifying professional activity.

The 20% rate concerns qualifying Portuguese employment or professional income in categories A and B. Foreign-income treatment has important exclusions: pensions do not receive the general foreign-income exemption, and listed preferential jurisdictions can trigger adverse treatment. The tax authority’s FAQ gives a Dubai-dividend example taxed at 35%. The ten-year period runs consecutively; late registration does not recreate missed years. The ordinary January 15 registration and change-notification deadlines should be built into the arrival plan.

CFC attribution can affect individuals and companies

Portugal’s corporate Article 66 and personal Article 20 both matter for international owners. The personal rule can reach direct or indirect holdings or rights of at least 25%, including fiduciary or intermediary arrangements. The corporate low-tax test includes a listed preferential jurisdiction or actual foreign profits tax below half the corresponding Portuguese liability. Attribution may arise without a dividend being paid.

Exceptions require analysis of the income mix or qualifying genuine activity, rather than merely a foreign address. Article 66 contains an exclusion linked to specified passive or low-value categories not exceeding 25% of total income and a separate EU/qualifying EEA genuine-economic-activity provision. Keep accounts, the ownership chain and the comparative tax calculation. A foreign company may also become Portuguese resident through its seat or effective management, which is a different question from CFC attribution and can change the entire corporate filing position.

Prepare a visa file and the later AIMA file separately

For a residence-visa route, confirm the competent consulate, the correct category, income evidence, accommodation, criminal records, insurance and required authorisations. The visa permits the next immigration stage; it does not itself replace the residence-permit decision. Appointment availability, document legalisation and requests for supplementary evidence can be the practical bottlenecks. A published statutory decision period is not a reliable end-to-end move date.

At the AIMA stage, present the current evidence supporting lawful entry, means, accommodation and the chosen residence basis. Keep copies of the entire consular file because evidence may need updating. For ARI, legal and financial due diligence on the investment should precede commitment; programme eligibility does not certify investment quality or liquidity. Preserve the banking trail and independent confirmation that the investment meets the precise statutory category.

Partial-year departure has important exceptions

Article 16 generally ends residence on the last day of stay, but its exceptions can retain residence across a wider period. These include returning as resident in the following year and specified cases involving more than 183 days in the departure year followed by income outside Portugal. The statute contains qualifications based on comparable foreign taxation and the destination, so the result requires the actual post-departure income and timeline.

Portuguese nationals moving to a jurisdiction on the statutory preferential-tax list face an additional rule potentially maintaining residence for the move year and four following years, unless valid reasons are established. This is not a rule applying identically to every nationality or every low-tax destination. Keep evidence of the genuine relocation, the new residence basis and foreign tax treatment before changing the tax registration.

The applicable rules changed on 19 May 2026

New nationality applications fall under the 2026 reform, while pending applications continue under the previous version. For ordinary adult naturalisation, the residence period is seven years for nationals of EU states or countries where Portuguese is an official language, and ten years for other nationals. Marketing that simply promises Portuguese citizenship after five years is therefore unsuitable for a new applicant.

The consolidated law also sets the accumulation windows: qualifying legal residence can be consecutive or interrupted within the prescribed nine- or twelve-year window for these groups. The prior provision relevant to counting pending residence-permit application time was repealed. Identify the exact residence titles, dates and transitional position from the current Article 15 rather than transferring an old online calculator into a 2026 application.

Language, civic knowledge and subsistence are distinct conditions

The revised adult naturalisation requirements include sufficient Portuguese language and cultural, historical and national-symbol knowledge, knowledge of fundamental rights and duties and the political organisation of the state, and a formal commitment to democratic rule-of-law principles. The law also specifies serious-crime, national-security and restrictive-measure conditions and the ability to support oneself.

The Justice Ministry warns that practical application of several provisions depends on implementing regulation and procedural interpretation. This guide therefore does not claim that an old language certificate alone completes every new knowledge requirement or invent a current universal examination format. Obtain the current IRN checklist for the relevant route before booking tests or submitting. Residence permission, tax residence and naturalisation eligibility remain separate concepts.
