A departure sequence that protects the evidence
The order follows legal and practical dependencies. Preparation time, appointments and authority assessment are separate; these stages are not an approval guarantee.
01Fix the proposed residence eventBefore signing transfers or changing treaty residence
02Build the asset and valuation scheduleBefore the trigger
03Model cash and payment choicesBefore selecting a payment arrangement
Compare immediate payment, instalments and deferral with interest, security and later-distribution consequences.

04File the move and tax claims separatelyAt the applicable reporting events
A move can have three different legal dates
Moving out of the population register, ending Norwegian domestic tax residence and becoming resident elsewhere under a treaty are distinct events. The difference can matter financially: the individual exit regime can be triggered by a treaty-residence change before domestic residence ends.
Work backwards from the intended household and business change. Establish which homes remain available, where family members live, how much time will be spent in Norway and where the owner will continue to work. This is a factual file, not just an overseas address.
The domestic departure test
| Item | How it works | Planning consequence |
|---|---|---|
| Less than ten years of Norwegian tax residence | Permanent settlement abroad, no more than 61 Norwegian days in the relevant year and no qualifying accessible home | Each commenced day counts; spouse, cohabitant and minor children’s housing access matters. |
| Ten years or more | Moving year plus at least three further years of continuing liability | The 61-day and housing conditions must be met during the three following years. |
| Housing exceptions | A holiday home or qualifying five-year unused dwelling can be retained | Do not assume every rented-out dwelling qualifies; examine ownership and use history. |
| After cessation | Norwegian-source income/wealth may remain taxable | A final move does not necessarily mean the last Norwegian tax return. |
What the individual exit regime actually covers
The current regime concerns specified financial assets, including shares and interests, relevant funds and account wrappers, options and certain share-related rights. It is not a flat departure tax on every item of personal property. For each asset, establish the relevant rule, valuation date and portion of gain within Norwegian exposure.
Rules changed materially from 20 March 2024. Later changes also affect distributions and cross-border estate transfers. A current departure must not be analysed using the old five-year lapse or old threshold simply because an older article remains online.
Emigration and transfers have different thresholds
| Item | How it works | Planning consequence |
|---|---|---|
| Emigration under the current regime | NOK 3 million basic deduction | For EEA emigration, covered gains and losses are netted; for a move outside the EEA, losses do not offset gains in the same way. The deduction is not the separate transfer threshold. |
| Specified transfers abroad | NOK 100,000 threshold | When applicable and exceeded, the whole taxable gain is relevant; it is not the emigration deduction. |
| Simple illustration | NOK 4 million qualifying share gain less NOK 3 million = NOK 1 million | At 37.84%, NOK 378,400, assuming that rate and base apply and all relevant basis/shielding adjustments have already been made. This is not a personalised calculation. |
Deferral changes cash timing, not the need to plan
Current payment choices include immediate payment, annual instalments over twelve years or payment at the end of the twelve-year period, with different interest and security consequences. Deferred liabilities also bring reporting and event-monitoring duties.
Under the distribution rules effective from 7 October 2024, 70% of relevant distributions is generally applied toward the deferred exit liability, with repayment limited so that it and tax on the distribution do not together exceed the distribution. Certain loans and transfers of value are relevant too. A plan to live from dividends abroad therefore needs a post-departure cash-flow model.
Do not assume a later fall in value, foreign capital-gains tax or a return to Norway automatically produces the same relief as under an earlier regime. Test the applicable version, dates and asset history.
The company may have its own departure problem
An owner leaving Norway does not by itself relocate a Norwegian company. Conversely, moving management, assets or contracts can raise company residence, permanent-establishment and corporate exit questions. Separate the owner’s personal share exposure from the enterprise’s own tax events.
For the household, create an evidence calendar for visits and housing access and keep destination residence documents. For the company, record who makes decisions after the move, what authority Norwegian staff retain and which reporting responsibilities continue.
