Separate EU movement, work and business permissions

EU/EEA/Swiss citizens should begin with the free-movement framework and registration for the planned length of stay. Third-country nationals need a route matching the activity: employment, highly qualified work, a genuine business/start-up, studies or family circumstances. A Schengen visitor entitlement is not permission to work locally.

MIGRIS is the practical starting point for the current application and evidence list. Application locations, appointment availability and admissibility can change. Do not sign a time-sensitive employment start or long lease on the assumption that the right to visit means the right to remain while an application is considered.

The 2026 work quota changes the practical route

The Migration Department reported on 31 July, with a September update, that the ordinary annual work quota was effectively exhausted when pending applications were considered. It expressly retained salary-based alternatives and the possibility of an additional eligible sector quota. That is different from a ban on every new foreign worker.

The notice identifies an ordinary post-quota salary condition of 1.2 times the latest annual average monthly gross wage and a separate listed high-value shortage-profession condition at one times that figure. Its quoted benchmarks were EUR 2,893.68 and EUR 2,411.40 respectively. Confirm the current benchmark, occupation and employer eligibility at filing rather than freezing a future contract around a headline from an older guide.

Family members: ages and sponsor conditions

For ordinary third-country family reunification, the sponsor’s status and residence history matter. Some sponsors must already have two years of lawful residence, a permit valid for at least a year and reasonable prospects of permanent residence. Exempt categories, including qualifying highly skilled and research situations, require their own branch.

The family route is not a single age limit for everyone. Prepare civil records, custody and dependency evidence for each person, and check how an approaching eighteenth or twenty-first birthday affects the application. The older Commission procedural page is useful for categories, but current filing instructions should come from MIGRIS.

IssueWhat matters
Child joining resident parentOrdinary category concerns an unmarried child under 18; custody/consent and sponsor conditions matter.
Spouse or registered partnerWhere joining a foreign permit holder, both normally at least 21, subject to the specific statutory exceptions.
Dependent parentDependency and the absence of another supporting family member can be relevant; not automatic inclusion of all parents.
EU citizen’s familySeparate EU-family definitions; do not import the ordinary third-country age test.

Application stages and the documents that can delay them

The sequence below separates preparation from an authority’s processing clock. No universal end-to-end number is promised: legalisation, appointments, employer evidence and a request for further documents can be decisive. Obtain the current route fee and decision period from the selected MIGRIS service before filing.

Residence is not a fixed-date passport promise

Long-term residence and nationality have separate residence, absence and integration conditions. Ordinary naturalisation generally requires ten years of legal permanent living; marriage and historic-citizenship categories have different provisions. Neither a company nor a residence card guarantees a nationality decision.

We can assess the immigration choice alongside tax residence, company management and banking. Any implementation engagement should specify the route and services actually supported; this comprehensive guide is not a catalogue of every service offered.
