Residence and income source come first

The Revenue Department’s current foreign-income chart uses presence of at least 180 days in the calendar year when income is earned. Thai-source income needs separate analysis regardless of remittance. Work performed while physically in Thailand can create a local-source issue; payment into a foreign account alone does not resolve it.

The foreign-income change from 2024

Official guidance addresses foreign income earned from 1 January 2024 by a person resident in the relevant year and later brought into Thailand. It distinguishes income earned before 2024 and years of nonresidence. Reconcile the chronology, nature of receipts and any treaty relief rather than treating every international transfer as taxable income or every old account as exempt.

Programme benefits are specific

LTR categories have different employment and tax features. DTV and Thailand Privilege are not general personal-tax holidays. A company owned abroad introduces further questions about local activity, management, permanent establishment and the owner’s other countries. This draft does not assert a verified absence of Thai CFC legislation or price tax savings without a fact-specific model.

Use four questions to analyse an overseas transfer

First, is the amount income or a movement of existing capital? Second, if it is income, where is its source? Third, when did it arise and was the recipient Thai resident in that year? Fourth, when and how was it brought into Thailand? The Revenue Department’s post-2024 guidance makes these distinctions important. It does not classify every bank transfer as income, nor does it exempt new earnings because they passed through an old account.

For an investment sale, retain the acquisition cost and sale records so the proceeds can be separated from any gain. For a pension or business distribution, identify the legal category rather than relying on the bank transfer description. Maintain separate supporting schedules for pre-2024 income and income earned in nonresident years; those factual distinctions can be more valuable than choosing a particular transfer service.

Local work is a different source question

Thailand’s rules address income from employment or business carried on in Thailand, as well as relevant Thai assets. A person physically performing services there should not assume the receipts are foreign-source solely because the client, company or bank account is overseas. The immigration permission for remote work does not itself settle the tax source.

A business owner should map the work performed personally, authority to conclude contracts and management of foreign entities. An employer should consider its own obligations separately from the employee’s personal return. If two jurisdictions tax the same payment, identify the treaty provision and credit mechanism and retain evidence of the foreign tax actually paid. A credit is not automatically equal to every foreign charge.

LTR relief is category-specific and needs evidence

The BOI material distinguishes the foreign-income benefits for qualifying LTR categories from the 17% employment-income treatment associated with qualifying highly skilled professionals. DTV and Privilege do not confer the same tax package. Establish the person’s category, period of qualification and precise receipt before applying any concession. A family member’s status should not be assumed to copy every tax feature of the principal.

Keep the endorsement and visa records alongside income, travel and tax schedules. Review the position when the job, employer, investment or category changes, and before the five-year qualification review. The current 2026 return materials include a foreign-income declaration; an immigration approval does not remove the need to determine filing obligations. For calculations, use the rules actually in force for the tax year rather than a media report about possible reform.
