A departure sequence with the tax work first
The stages follow dependencies. Preparation, appointments and authority review take separate amounts of time; legal deadlines are identified individually and are not approval promises.
01Map the intended move and transactionsBefore binding transactions
List countries, residence history, holdings, business assets and proposed sale/distribution dates.
Documents & evidence
- Residence chronology
- Acquisition and ownership records
02Agree the company and asset treatmentBefore moving management or assets
Distinguish personal residence, corporate residence and assets leaving Luxembourg taxing jurisdiction.
Documents & evidence
- Management record
- Valuations and transaction drafts
03Give notices and arrange replacement coverageAccording to the relevant notice periods
04Complete returns and preserve the fileFollowing the move and through final assessment
A departure declaration does not settle every tax question
Notify the commune of the actual move and establish the tax facts independently: the availability of homes, where the household lives, employment and continuing business activity. A foreign card does not prove Luxembourg residence ended on the same date. Conversely, becoming nonresident does not automatically remove Luxembourg-source income from assessment.
Create a timeline for salary, bonuses, pensions, rents, dividends and disposal proceeds around the move. Confirm the destination’s residence start, treaty position and opening tax bases before assuming one country’s departure value will be accepted by the other.
Moving the owner and moving the business are different events
If the company retains Luxembourg central administration or its statutory seat, it may remain resident even after the shareholder moves. If administration, assets or a permanent establishment leave, articles 38 and 172 can become relevant. Establish which taxing rights Luxembourg retains, the values involved and any payment mechanism available for the actual destination.
A dormant company still needs decisions on returns, accounts, address, beneficial ownership and banking. Closing a business is not the same as ceasing to use its account. Obtain a defined wind-down or continuation plan with named responsibility for the final periods.
Close the household without losing the evidence
Check lease notice and inventory requirements, retain forwarding details and reconcile utility charges and deposits. Confirm when Luxembourg social coverage ends and when replacement coverage starts, especially for cross-border employment or family members whose cover depended on the principal.
The current family guidance requires notification to immigration and the commune for a departure exceeding six months. The consequences differ by nationality, permit and the length of absence. Do not assume an unexpired physical card preserves every right while living elsewhere.
Retain access through the final filing cycle
Keep tax records and electronic access after leaving, update the appropriate correspondence details and review the final resident/nonresident periods. Model 100 normally falls due by 31 December of the following year where a return is required; payment notices and a particular authority request may create separate actions.
Our review can identify the departure triggers, assess the destination alongside them and coordinate the agreed implementation. Provide the intended departure and transaction dates early: valuation and corporate decisions are harder to reconstruct after the event.
