Citizenship is a nationality decision, not an investment product

Japanese nationality is acquired under the Nationality Act, including descent and naturalisation. Buying property, establishing a company or holding permanent residence does not itself confer nationality. A child with a Japanese parent may acquire nationality under the statutory rules, but birth in Japan alone is not a general citizenship entitlement for children of foreign parents.

Naturalisation requires the Minister of Justice’s permission. The Legal Affairs Bureau assesses the individual record; reaching a numerical threshold is not a guarantee. Permanent residence and naturalisation are separate applications with different legal consequences. A person who wants indefinite residence but wishes to retain an existing nationality should analyse those alternatives before pursuing citizenship.

For children born abroad who acquire another nationality at birth, Japanese nationality-retention notification can be time-sensitive. Do not assume a foreign birth certificate or a parent’s passport settles the child’s status. Establish the family-register and notification position promptly with the responsible authority.

The five-year statute and the ten-year policy are different layers

Article 5 ordinarily requires at least five consecutive years of domicile in Japan, age 18 and legal capacity under the applicant’s home law, good conduct, an adequate livelihood through the applicant or qualifying household, and the nationality-related conditions. The residence must be lawful. Taxes, pension, insurance, criminal history and the actual household circumstances belong in the assessment.

A Ministry of Justice announcement dated 27 March 2026 changed the operational review from 1 April 2026. It states that the review of integration into Japanese society will generally consider a stay of at least ten years and will examine tax and social-insurance compliance over a longer period. This is a material current policy change; it is not an amendment replacing “five” with “ten” in Article 5.

The distinction matters when planning an application. A five-year statutory gateway does not justify selling a guaranteed five-year citizenship path under the current review policy. Conversely, the announcement does not justify deleting statutory family exceptions or assuming every application is decided mechanically at ten years. Obtain a case-specific preliminary consultation, especially where an exception or an application spanning the policy change is involved.

Marriage can change conditions but does not grant citizenship automatically

Article 7 allows relaxation of specified ordinary conditions for a spouse of a Japanese citizen who has had domicile or residence in Japan continuously for at least three years and is currently domiciled in Japan. It also covers a spouse married for at least three years who has continuously had a Japanese domicile for at least one year. These are distinct statutory alternatives, not a rule that any marriage immediately creates an entitlement.

The provision relaxes the ordinary residence and age/capacity conditions specified in Article 5; other requirements and ministerial discretion remain. The current operational policy must also be addressed with the Legal Affairs Bureau. This research does not establish that all Article 7 cases receive a fixed one-year or three-year approval timetable.

Other provisions address people with specified Japanese family connections, former nationality and certain children. Map the actual family history before selecting a route: birth, adoption, recognition of parentage, marriage, divorce and name changes can each alter the documentary chain. A municipal partnership certificate is not interchangeable with a nationally recognised marriage for nationality purposes.

Naturalising in Japan normally requires a nationality choice

The ordinary naturalisation conditions require that the applicant has no nationality or loses the previous nationality on acquiring Japanese nationality, subject to a narrow statutory exception where loss is impossible regardless of the person’s intention and special circumstances involving a Japanese relationship are established. Foreign-country renunciation procedures and the sequence of permissions therefore need advance review. Do not renounce prematurely and create an avoidable statelessness problem.

People who already hold Japanese and another nationality are subject to the Nationality Act’s choice rules. Under the current age framework, a person who became dual before age 18 generally must choose by age 20; someone becoming dual at 18 or later generally has two years. The procedures and consequences depend on how nationality was acquired and which declaration is made. It is inaccurate to describe every missed birthday as an automatic loss without examining the statutory process.

A Japanese national who voluntarily acquires a foreign nationality can lose Japanese nationality under Article 11. That is separate from dual nationality arising at birth. Before acquiring another citizenship, obtain advice on both countries’ laws, family-register records, inheritance planning and the right to continue living in Japan.

Build the record before arranging the formal application

Begin with the Legal Affairs Bureau responsible for the Japanese address. The required documents vary with nationality, employment, business ownership and family history. Expect to reconcile home-country civil records with Japanese residence, tax, pension, health-insurance and family records; translations and inconsistencies can be a substantial part of preparation.

An entrepreneur should make company filings, remuneration, social-insurance enrolment and personal living costs understandable as one financial story. Undeclared foreign income or missed public payments are not cured by a profitable company. Keep evidence of compliance, explanations for genuine errors and the steps taken to resolve them.

Budget separately for official certificates, translations, foreign record procurement and any professional help. The reviewed sources do not establish a universal end-to-end approval time or a fixed all-inclusive preparation cost. Keep valid immigration permission throughout the process and report material changes rather than treating a pending nationality application as a residence extension.

Decide what you need nationality to accomplish

The decision can affect existing citizenship, family rights, passport use, tax categorisation and future relocation. Japanese nationality removes eligibility for the non-permanent-resident income-tax category, which is limited to non-Japanese nationals; it does not by itself turn Japan into a citizenship-based worldwide tax system for all Japanese nationals living abroad.

We can integrate the residence and nationality assessment with business, investment and family planning, and coordinate the appropriate local specialists. An initial inquiry should identify your nationality history, continuous Japanese residence, spouse/children, current status and any nationality you intend to retain.
