Eligibility & suitability

Who can qualify

  • Existing applicants or holders whose dates and legal position fall within applicable transitional provisions.

Restrictions & unsuitable cases

  • New applications presented as an open investor route after 3 April 2025.
  • Property buyers relying on a reservation or sales promise without evidence of a protected immigration filing.

Application process & timeline

The sequence below separates application preparation, official decision stages and continuing obligations. A statutory deadline or published target is not an estimate of end-to-end delivery.

01Locate the actual immigration recordBefore relying on transitional protection.+

Collect the filing receipt, application type and date, resolution and card. Separate these from the property transaction documents.

Documents & evidence

  • Filing receipt
  • Resolution
  • Residence card
Common complications
  • Treating a property deposit as an immigration application

02Apply the relevant transitional provisionBefore renewal or further spending.+

Have the original case checked against the repeal and transition rules. Identify what remains valid and which conditions must continue.

Documents & evidence

  • Original legal basis
  • Investment evidence
Common complications
  • Assuming all pending and approved cases are treated identically

03Protect current lawful statusBefore expiry or travel.+

Confirm the renewal or alternative application route and the document supporting lawful stay. Address family members separately.

Documents & evidence

  • Expiry calendar
  • Family permissions
Common complications
  • Waiting for expiry while discussing alternatives

04Compare open routesPreparation time varies by the replacement route.+

Test work, income, qualifications and family circumstances against an actually open category. Do not use the former investment threshold as the new eligibility test.

Documents & evidence

  • Work/income records
  • Family facts
  • Qualification records
Common complications
  • Moving into an incompatible no-work category

05Implement the verified route and tax planOnly after category and timing are established.+

Submit the appropriate application and coordinate tax residence, housing and company management. Preserve records of the original case for future renewals.

Documents & evidence

Do not buy property on an obsolete premise

Spain’s consular guidance states that the investor visa is no longer available from 3 April 2025. A property purchase today should not be marketed as a new Spanish golden-visa application. Historic articles and property listings can remain online long after the legal route closes.

Existing cases are a different question

If you already held a permission or filed before the change, gather the original application, filing receipt, decision, investment records and expiry date. Transitional provisions and renewal conditions must be checked for that precise situation. A closure to new applications does not itself answer every question about an earlier permission.

Avoid making an investment disposal, changing ownership or allowing a card to expire before that review. The fact that another applicant renewed successfully does not establish that your case has the same procedural history.

Choose an alternative around the real activity

An active remote worker may have a different route from a retired household supported by investments or an entrepreneur seeking to operate locally. Compare the actual immigration conditions, work rights, presence expectations and family position. Do not force a new plan into the shape of a discontinued investment product.

Tax consequences remain independent: owning Spanish property, becoming resident or managing a business from Spain can create obligations regardless of which immigration route is used. The total plan should include property costs, insurance, professional fees and recurring filings.

How we can help

We can review whether Spain still suits the household, evaluate a suitable open route and coordinate the arrival and cross-border structure. For a legacy investor case, start with the documentary history so the next step follows the rules that actually apply. No investment or alternative programme should be described as guaranteeing a future passport.

No new investment application should be offered

Spain ended new investor-visa applications from 3 April 2025. Buying a property after the closure does not revive the route. This page is retained to explain the change and help readers assess an existing case, not to advertise an open product. A broker’s description of property as “golden visa eligible” is insufficient evidence after the repeal.

For an existing applicant or holder, the crucial records are the filing date, type of application, original legal basis, approval and expiry. Transitional protection must be checked under the specific provision covering that case. A reservation agreement, transfer of funds and a formally submitted immigration application are different events. Do not assume the earliest commercial event is the date that preserves immigration rights.

Choosing an alternative around the actual activity

Alternatives can include a qualifying teleworker route, employment, entrepreneurship, family rights or a non-lucrative residence category. They have different work permissions and financial conditions. Someone who manages an online company cannot simply select a no-work route because the income is paid abroad. Likewise, a teleworker permission is not available for every property investor.

Separate the decision to buy the property from the decision to move. A home can remain a sensible personal investment without creating immigration eligibility, and ownership may still produce Spanish property taxes or rental obligations. If the family relocates, ordinary tax-residence rules and any independently available tax election must be reviewed. The old investment amount has no role in guaranteeing a replacement permission.
