What the tax system covers

Ordinary residents are taxed on worldwide income. The Article 93 impatriate election has a different, limited framework; wealth taxes, social security and source-country taxes require separate calculations.

When you become tax resident

Spain’s domestic individual-residence tests include more than 183 days in the calendar year, with sporadic absences generally counted unless foreign residence is demonstrated. Residence can also follow the principal centre of economic activities or interests. There is a rebuttable family presumption where the non-separated spouse and dependent minor children habitually live in Spain. A foreign card or fewer Spanish days does not automatically defeat those alternative tests. Ordinary residents generally face worldwide taxation. Identify the relevant autonomous community as well as the national rules, because regional taxation can affect the total result. A person keeping homes in two countries needs a treaty analysis supported by actual use, family life and economic ties. An NIE is an identification number, and municipal registration is evidence of facts; neither should be confused with a complete tax-residence determination.

Rates and the tax base

Progressive state and autonomous-community rates. Ordinary general income requires both the state and the relevant autonomous-community schedules; a state-only percentage understates the combined charge. Savings income has a separate scale. The Basque Country, Navarre, regional deductions and special-regime eligibility need their own analysis.

Private investment gains and business trading

IRPF includes gains and losses arising from asset disposals, including private investments. The savings and general bases have different classification and offset rules; exemptions and regional or special-status rules require review. The cited practical manual is for the 2025 income year, filed in 2026, and should not be mistaken for a universal flat capital-gains rate.

Asset cost basis on arrival

Under ordinary IRPF rules, a purchased asset’s gain starts from acquisition value and disposal value. An arrival valuation does not, by itself, replace the original purchase cost.

  • Acquisition value can include eligible costs and improvements and must reflect relevant depreciation.
  • This classification applies the published ordinary computation rules to pre-residence purchases; special impatriate status, treaties, gifts, inheritance and particular assets require separate review.

Inherited or gifted propertySeparate acquisition-valuation rules apply.
Special impatriate regimeFirst establish whether the gain is in scope; an exemption or source limit is not a cost-basis reset.

The impatriate election has a limited qualifying perimeter

Article 93 can give eligible arrivals a special income-tax framework for the arrival tax year and five following years. The previous-nonresidence condition is generally five tax years, and the move must arise through an accepted employment, director, entrepreneurial or qualifying professional circumstance. The digital-nomad immigration permission and the tax election are separate applications. Professional athletes and people whose activity falls outside the permitted categories should not assume eligibility.

Covered employment income is taxed at 24% up to €600,000 and 47% above it under the current statutory scale; other income classifications require their own rules. The election is not a blanket foreign-income exemption, especially for employment income treated as Spanish-source under the regime. Model social security, wealth exposure and any foreign tax or treaty consequences alongside the headline salary rate. The election deadline and supporting activity evidence must be established before filing Form 149.

Wealth and departure can change the overall economics

An income-tax estimate is incomplete for an owner with substantial assets. Review the applicable wealth-tax rules, regional provisions and the state solidarity tax on large fortunes, including exemptions, debt allocation, valuation and the interaction between taxes. Nonresidents can retain Spanish-asset exposure. Avoid inferring a zero total wealth bill from a single regional rebate.

Spain also has a personal departure rule for latent share gains after the residence-history and value tests are met. It concerns shares and participations under Article 95 bis, not a universal deemed sale of every asset. The standard history condition is ten of the preceding fifteen tax periods, with special counting for former impatriate-regime users. Record ownership, acquisition cost and private-company valuation before moving to Spain so a later sale or exit can be modelled accurately.

Establish the departure-year residence result first

Spain generally assesses personal residence by calendar year. More than 183 days is one test, but economic interests and the family presumption can also matter. A new foreign home or residence certificate must be reconciled with retained Spanish accommodation, family and business activity. Do not assume a departure stamp automatically creates a domestic split year.

Prepare a timeline covering the whole year, including sporadic absences and evidence of genuine residence in the destination. Review the treaty if both countries claim the individual. Separate the person’s tax registration update from the legal residence conclusion. A bank address change or cancellation of a municipal record may be useful evidence, but it does not override the statutory facts. Keep the supporting documents for both countries’ departure and arrival returns.

Apply the personal share exit-tax thresholds precisely

Article 95 bis generally applies after the person was an ordinary income-tax taxpayer in at least ten of the fifteen periods preceding the final return period. The aggregate market value of shares or participations must exceed €4 million, or the person must hold more than 25% in an entity whose relevant holding exceeds €1 million. In the latter case, the affected gain is limited to that qualifying holding.

The charge concerns positive unrealised differences between market value and acquisition cost. A founder with valuable private shares can therefore face a liquidity problem despite receiving no sale proceeds. The tax authority states that the ten-year count for former impatriate-regime taxpayers begins with the first period after that regime ceases to apply. Obtain defensible private-company valuations, acquisition history and any prior restructuring analysis before moving.

Destination and later events affect exit treatment

Article 95 bis contains different mechanisms for qualifying temporary moves and EU or EEA moves with the required information-exchange conditions. Their reporting requirements and subsequent-event triggers matter. Do not describe these mechanisms as a universal exemption or promise that moving within Europe automatically eliminates the charge. Establish whether an election, notification, security or later monitoring is required for the actual case.

A later share disposal, onward relocation or return can change the result. Preserve the departure valuation and ongoing event calendar even after the last ordinary Spanish return. The company’s own migration or transfer of business assets is a separate tax event; the shareholder’s personal exit-tax calculation does not determine the company’s residence, permanent establishment or transfer-pricing position.
