Eligibility & suitability
Who can qualify
- New Spanish tax residents satisfying the prior non-residence test and a qualifying statutory move/activity category.
- Eligible associated family members meeting their separate conditions.
Restrictions & unsuitable cases
- Applicants whose only qualification is being a foreign business owner or digital nomad.
- Professional athletes within the excluded special employment relationship.
- Applicants expecting every foreign receipt or investment to be outside Spanish tax.
Application process & timeline
The sequence below separates application preparation, official decision stages and continuing obligations. A statutory deadline or published target is not an estimate of end-to-end delivery.
01Test the five-year history and qualifying moveBefore moving or starting the role.
02Model the complete tax positionBefore committing to the election.
Compare ordinary taxation with the special regime for salary, investment income, foreign withholding and wealth exposure. Include all proposed family elections.
Documents & evidence
- Worldwide asset/income schedule
- Foreign withholding analysis
- Comparing only the headline employment rate
03Record the activity start and supporting registrationsAt commencement of the qualifying activity.
Preserve evidence fixing the election clock and any foreign social-security continuation. Align immigration permission with actual work.
Documents & evidence
- Social-security records
- Employer certificate
- Arrival chronology
- Losing the evidence establishing the filing deadline
04File Model 149Generally within six months of the relevant activity commencement; confirm category rules.
Submit the option with prescribed evidence through the tax procedure. Retain acknowledgement and outcome, and resolve information requests promptly.
Documents & evidence
- Model 149
- Category supporting documents
- Assuming a visa application elected the tax regime
05Apply withholding and file Model 151Each covered tax year.
Ensure payers and the return use the correct regime and income categories. Review foreign tax-credit limits and family conditions.
Documents & evidence
- Regime evidence
- Withholding certificates
- Model 151
- Treating all income as taxed at 24%
06Review changes, exclusion and expiryWhen facts change and before the six-tax-year window ends.
Assess a new business role, job change, family departure or loss of conditions before acting. Prepare the ordinary-tax or departure position.
Documents & evidence
- Updated contracts
- Family/residence facts
- Transition model
- Assuming the election survives every change in activity

The label is broader than the original football story
Article 93 provides a special tax regime for eligible arrivals. The current rules cover specified employment and other qualifying situations, including certain remote workers, directors, entrepreneurs and professionals. The applicant must generally not have been Spanish resident in the previous five tax periods. Eligibility depends on the actual legal category and facts.
A residence permit or company appointment does not alone establish tax eligibility. Map the cause and timing of the move, the work relationship and any Spanish permanent establishment or other disqualifying circumstances. The phrase “Beckham law” should never substitute for identifying the statutory route.
Build an income map before calculating savings
The regime’s period is the arrival tax year plus five subsequent years, subject to its conditions. Different income categories receive different treatment. Employment and certain professional income cannot be treated as wholly exempt foreign income simply because it is paid through a foreign account.
A useful comparison models salary, business income, dividends, interest, property, capital gains and family holdings. Include social contributions and any tax retained elsewhere. Changes in the balance between salary and investment returns can materially alter the comparison with ordinary residence.
Application and evidence
Confirm the filing deadline against the actual registration or activity event. The Tax Agency’s process uses the applicable election form and supporting documentation; obtain the required tax identification and registration first. A late election is a practical risk that should be addressed before arrival, not discovered at the first annual return.
The supporting file should connect previous non-residence, the qualifying employment or activity, the move and the start date. Each family member seeking the regime needs a separate eligibility review. Save the authority’s confirmation and make clear which adviser owns the annual return and notifications of change.
What to review during the regime
A job change, new business, property acquisition, new company role or family move can change the analysis. Before accepting a new arrangement, check whether it remains compatible with the election. Prepare for the end of the regime with an asset and income forecast. We can compare it within a complete Spain arrival plan and help coordinate the practical implementation.
The regime is an election with a qualifying trigger
The current Article 93 framework generally requires no Spanish tax residence in the five preceding tax periods and a move connected to a qualifying employment, directorship, entrepreneurship or specified professional circumstance. The rules differ between categories. An ordinary freelancer does not qualify simply because the work is online, and company ownership can matter differently for a director of a patrimonial entity.
The benefit period is the residence-change year plus five subsequent tax years. A digital-nomad visa can support one factual category, but it does not itself constitute the tax election. Establish the causal connection between the move and the eligible activity with dated evidence: contract, appointment, work commencement, social-security documents and arrival history.
Tax scope, rates and foreign income
The employment/qualifying-business scale is 24% up to €600,000 and 47% above it under the current law. This is not a universal 24% rate on every type of receipt. Spanish-source investment income has its own scale and the regime treats covered employment income as Spanish-source even where the payer or workdays are abroad, subject to the specific statutory rules.
The Tax Agency notes that participants are not treated as treaty residents for ordinary double-tax-treaty purposes because of the restricted basis of taxation. That can materially change foreign withholding and relief. Review foreign dividends, property, gains, trusts and pensions item by item; a favourable Spanish treatment does not force the source country to waive tax. Also examine wealth and solidarity-tax exposure separately rather than treating the income-tax election as the whole personal-tax position.
Claim, return and family coordination
Model 149 is used for the option, withdrawal or exclusion; Model 151 is the annual return for the special regime. The option deadline is generally tied to the start of the relevant activity and social-security evidence, not to a leisurely decision after the first ordinary tax return. Confirm the applicable six-month rule and supporting documents for the actual category before work begins.
Certain family members can elect subject to their own conditions and limits linked to the principal. A spouse’s independent earnings and residence history therefore belong in the initial model. At the end of the regime, ordinary worldwide taxation can substantially change the result. Plan the transition and any departure under the law then applicable, without assuming a fresh short absence restarts eligibility.
