Eligibility & suitability
Who can qualify
- Applicants with a demonstrable current descent, registration, naturalisation or exceptional-merit basis under Maltese law.
Restrictions & unsuitable cases
- Applicants seeking an open transactional citizenship-by-investment offer based on the former model.
- Permanent residents assuming card ownership automatically satisfies citizenship conditions.
Application process & timeline
The sequence below separates application preparation, official decision stages and continuing obligations. A statutory deadline or published target is not an estimate of end-to-end delivery.

02Map eligibility dates and family factsPreparation variable.
03Confirm the authority’s current requirementsBefore filing.
Obtain the route-specific checklist, evidence standard, fees and any required preliminary assessment from the agency.

The former investment model is not an open offer
On 29 April 2025, the Court of Justice of the European Union held Malta’s 2020 investment-citizenship scheme contrary to EU law. Current citizenship advice must account for the legal changes that followed. Older programme brochures, fee schedules and service pages are not a sufficient basis for a new application.
Merit is not a replacement price list
Community Malta Agency’s February 2026 clarification states that citizenship by merit is not a programme or an investment alternative, and rejects promotion of it as such. Exceptional contributions and discretionary consideration cannot honestly be turned into a guaranteed passport package.
If a person believes they have a credible basis, the first task is a legal review of that basis, the current legislation and the agency’s procedure. A commercial introduction, charitable payment or proposed investment does not establish entitlement. Do not commit funds on the assumption that a favourable decision has been purchased.
Ordinary and family routes remain separate
The agency describes acquisition pathways including descent, registration and ordinary naturalisation. For the ordinary residence route, the published conditions include the preceding twelve months and an aggregate of four years in the previous six, alongside language, character and suitability requirements. Meeting a minimum residence period does not remove ministerial discretion.
Build the history from actual lawful residence and civil documents. MPRP or another residence permission may help someone live in Malta, but a residence card is not itself citizenship. Absences, integration and the applicant’s individual circumstances require a route-specific review.
Compare the result the family actually needs
For some families, secure residence is enough; others need nationality rights for children, work or long-term mobility. Start with that objective and evaluate lawful routes across jurisdictions. We can help organise the research and implementation, while keeping discretionary decisions and unresolved eligibility visible. This page does not market Malta citizenship by investment as an available product.
The Court ruling and current merit framework
The Court of Justice judgment of 29 April 2025 found Malta’s institutionalised citizenship-by-investment scheme incompatible with EU law. The agency’s February 2026 clarification describes citizenship by merit as a distinct framework and rejects its presentation as an investment programme. This guide therefore does not quote a donation price or delivery timetable for buying Maltese citizenship.
A marketing label can conceal very different legal routes. Descent or registration may depend on a documented family relationship; ordinary naturalisation depends on statutory residence and other conditions; exceptional merit involves an individual assessment. None should be substituted for another simply because the applicant can make an investment. Obtain the current legal basis and application procedure directly from the competent agency before committing to any proposal.
How to investigate a genuine route
Begin with birth, parentage, marriage, adoption, prior nationality and residence records. Map the relevant dates before requesting expensive foreign certificates: an ancestor’s status at a birth or a change in law can determine which documents matter. For residence-based naturalisation, distinguish lawful permission, physical residence and the authority’s discretionary assessment. A permanent residence card alone is not proof that all nationality conditions are met.
For merit, evidence must relate to the actual exceptional contribution and current criteria, not a promised payment package. This draft does not claim a verified fixed minimum investment, standard guaranteed processing time or automatic family extension for merit. Those are precisely the assumptions the official clarification warns against. A proposal should state what is established, what is discretionary and what remains unverified.
Rights and the separate immigration plan
Maltese citizenship carries EU citizenship rights, while MPRP gives a different set of residence and short-travel rights. A family needing a place to live soon should assess an available residence route without assuming citizenship will arrive on the same timetable. Keep present lawful status valid during any nationality investigation.
Also review the existing nationality’s dual-citizenship rules and the implications for children. Obtaining a new passport does not automatically end tax residence elsewhere or erase reporting obligations. Tax, succession and business-management planning should follow the family’s actual move and legal relationships rather than the passport alone.
