Identify an existing claim before pursuing naturalisation

Birth, parentage and naturalisation can each be relevant. A person with a U.S. parent may need an acquisition or transmission analysis based on the law and facts at the relevant dates. Do not assume that holding another passport settles whether U.S. citizenship already exists.

For many adult permanent residents, ordinary naturalisation is based on five years of qualifying permanent residence. Special routes can differ, including certain spouses and military applicants.

Residence and physical presence are different tests

Under the ordinary five-year framework, the applicant normally needs continuous residence and at least 30 months of physical presence in the relevant period, together with other eligibility requirements. Long absences can disrupt continuity even when a green card remains valid.

A frequent traveller should keep a day-by-day record and review planned absences before they become a problem. The permanent-resident card, continuous residence and physical presence each answer a different question.

Understand the full process

  • Establish the correct eligibility category and relevant dates.
  • Review travel, good moral character, tax compliance and other potential obstacles.
  • Prepare Form N-400 and supporting records for the current application requirements.
  • Complete biometrics, interview and applicable English and civics requirements.
  • Take the oath if approved, then apply separately for passport documentation.

Investment is not immediate citizenship

EB-5 can lead to permanent residence if its conditions are met; it is not direct citizenship by investment. E-2 is a nonimmigrant category and does not by itself establish a naturalisation route. Marketing that collapses these stages conceals important decisions.

U.S. citizenship also carries continuing tax and reporting consequences while living abroad. A family should compare the long-term advantages of work and residence security with those obligations. We can help incorporate citizenship planning into a broader international structure without treating passport acquisition as an end in itself.

Permanent residence must be maintained before naturalisation

Naturalisation is normally a later step after a qualifying period as a lawful permanent resident. The common five-year route includes a physical-presence requirement, continuous residence and other eligibility conditions. Certain spouses and other categories have different statutory routes.

A green card used mainly as a travel convenience can create difficulties if the person does not actually maintain US residence. Long absences can affect immigration status and the separate continuous-residence calculation for naturalisation. Keep travel records and assess a proposed extended trip before departure.

The application has distinct procedural stages

Confirm the appropriate statutory route, then review residence, physical presence, tax compliance, good moral character and any bars. Prepare the current Form N-400 and evidence, attend biometrics if required and complete the interview and applicable English and civics requirements. A successful applicant then takes the oath before obtaining citizenship documentation.

The statutory eligibility period is not an application processing estimate. Appointment availability and government review vary, and an incomplete record can produce additional requests. Passport issuance is a separate step after the citizenship grant.

Citizenship changes the long-term planning assumptions

US citizenship generally maintains worldwide income-tax and reporting obligations even if the holder later lives elsewhere. Foreign business ownership, investment funds, trusts and bank accounts should therefore be considered before pursuing citizenship as an additional travel document.

The assessment should also cover the other country’s rules on multiple nationality and the family’s intended long-term residence. A second nationality can be valuable, but the benefit must be considered alongside the ongoing tax and reporting relationship. Expatriation is a separate, consequential future process rather than a routine cancellation of a passport.
