Tax residence can arise well before 183 days
Swiss federal rules distinguish tax domicile from a qualifying stay. Establishing a home with the relevant intention can create domicile; a stay can also trigger residence after at least 30 days with gainful activity or 90 days without it, subject to the statutory details and exceptions. A generic “under 183 days” plan therefore does not establish non-residence. Immigration permission, municipal registration and the tax analysis are related evidence but different legal questions.
The federal, cantonal and communal layers must then be considered together. An ordinary resident’s income and wealth assessment requires treatment of foreign property, businesses and treaty allocation rather than a simple worldwide-total calculation. The destination municipality can materially change the outcome. Before moving, identify the home, work pattern, family connections and foreign taxable assets, and request an analysis for the actual canton and municipality rather than relying on a Swiss national average.
Private capital gains and trading income are different
Gains on privately held movable assets are generally exempt from ordinary income tax, while gains on business assets and professional securities trading can be taxable. The FTA’s Circular 36 addresses the distinction between private investment and professional trading. Frequent transactions, leverage, derivatives, reliance on gains and the wider facts should be reviewed under that guidance; failure to meet a safe-harbour condition is not by itself a substitute for the complete analysis.
Dividends, interest and other investment income are not made exempt merely because a disposal gain is private. Real-estate gains follow their own cantonal system. Cantons and communes also levy wealth taxes, so an investor with low realised income can still have a recurring tax cost. Classify the portfolio, investment activity and legal owner before estimating the benefit. A trading business or a company’s portfolio does not automatically receive the treatment of an individual’s private investments.
Corporate seat and effective administration both matter
A legal entity can be Swiss tax resident because its seat or actual administration is in Switzerland. A foreign-incorporated company directed from a founder’s Swiss home therefore needs a residence analysis even if it has no Swiss customers. A separate permanent-establishment question can arise where business activity is conducted in Switzerland without the entire company becoming resident.
The corporate tax outcome combines federal and applicable cantonal/communal rules, with additional distinctions for capital taxes and qualifying reliefs. Moving only the shareholder does not relocate the company automatically, and a personal expenditure-based arrangement does not exempt the company’s income. Map the people who actually make decisions, their authority, the operating functions and the ownership of intellectual property and risk. A supported governance arrangement requires real conduct consistent with that map; foreign minutes or nominee appointments alone are not the analysis.
Expenditure taxation must fit the actual lifestyle and work
Qualifying foreign nationals may use expenditure-based taxation when settling for the first time or after the required absence and not undertaking gainful activity in Switzerland. Availability and implementation differ by canton. The calculation considers expenditure, statutory minima and a control calculation; it is not a single national annual fee that automatically replaces every tax.
A founder who intends to operate a business from Switzerland must examine whether those duties are compatible. Foreign customers or a foreign payroll do not settle the issue. Treaty relief can require additional income to enter a modified calculation, and Swiss-source property and income remain relevant. Obtain current-year figures for the proposed canton instead of reusing an old federal minimum. Compare the regime with ordinary taxation, including wealth and portfolio classification, and separately secure the appropriate immigration permission. Tax acceptance does not itself grant a residence permit.
